A BILL FOR AN ACT

 

 

relating to protests at funerals.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 711, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§711‑    Unlawful protest at a funeral.  (1)  A person commits the offense of unlawful protest at a funeral if that person engages in picketing or other protest activities within three hundred feet of any residence, cemetery, funeral home, church, synagogue, mosque, or other establishment during, within one hour before the start of, or within one hour after the completion of a funeral, burial service, or memorial service conducted at the subject location.

     (2)  For purposes of this section, "picketing or other protest activities" means a congregation of individuals for the purpose of drawing attention through visual or audible means that is disruptive to or that is undertaken with the purpose of disrupting or disturbing a funeral, burial service, or memorial service.

     (3)  Unlawful protest at a funeral is a misdemeanor."

     SECTION 2.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on July 1, 2011.
