A BILL FOR AN ACT
PROPOSING AN AMENDMENT TO ARTICLE vIII OF THE hAWAII state cONSTITUTION TO ENABLE COUNTIES TO create townships.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The legislature finds that counties could more efficiently and effectively provide for basic services, including law enforcement, fire protection, road maintenance and construction, solid waste and wastewater management, stormwater collection and disposal, municipal planning, and recreational facilities and programs, if counties were able to subdivide into townships.
The purpose of this Act is to propose an amendment to Article VIII of the Constitution of the State of Hawaii to
enable a county to have the power to create townships by an initiative created by registered voters within the proposed township area and approved by a vote of the residents of any discreet geographic area within the county comprising the proposed township.
SECTION 2. Article VIII of the Constitution of the State of Hawaii is amended by adding a new section to be appropriately designated and to read as follows:
"TOWNSHIPS
Section 1A. A county shall have the power to create townships by an initiative conducted upon a petition of registered voters within the proposed township area or a percentage of registered voters within the proposed township area, whichever is less, and approved by a vote of the residents of any discreet geographic area within the county comprising the proposed township. A township shall have powers, duties, and requirements as provided by law."
SECTION 3. The question to be printed on the ballot shall be as follows:
"Shall the counties have the power to create townships, which shall have powers, duties, and requirements as provided by law, by an initiative created by registered voters within the proposed township area and approved by a vote of the residents of any discreet geographic area within the county comprising the proposed township?"
SECTION 4. New constitutional material is underscored.
SECTION 5. This amendment shall take effect upon
compliance with article XVII, section 3, of the Constitution of the State of Hawaii.
