A BILL FOR AN ACT

 

 

relating to the penal code.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 707, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§707-      Assault against a water safety officer.  (1)  A person commits the offense of assault against a water safety officer if the person:

(a)  Intentionally or knowingly causes bodily injury to a water safety officer who is engaged in the performance of duty; or

(b)  Recklessly or negligently causes, with a dangerous instrument, bodily injury to a water safety officer who is engaged in the performance of duty.

     (2)  Assault against a water safety officer is a class C felony.

     (3)  For purposes of this section, a "water safety officer" means an employee of any county of the state whose principal duty is to stand guard over the beaches of the state and counties to ensure the safety of individuals thereon."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect on January 1, 2011.
