A BILL FOR AN ACT

 

 

relating to memorialS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that the office of veterans services, pursuant to Act 139, Session Laws of Hawaii 2013, and with the assistance of the department of accounting and general services, department of defense, and state historic preservation division, developed a plan to establish a memorial honoring the veterans of the Persian Gulf War, Operation Desert Storm, Operation Iraqi Freedom, Operation Enduring Freedom, Operation New Dawn, Global War on Terrorism, Homeland Defense, and Operation Noble Eagle, and those who have protected our borders by land, sea, and air.  In 2014, the department of defense and the office of veterans services published and presented the Gulf War memorial task force 2014 legislative report.  The report to the legislature included a recommendation requesting an appropriation to plan, design, and construct a memorial and replicas honoring these and other service members of the United States armed forces who have protected our borders.

     The legislature also finds that since 2014, many men and women have continued to serve in the United States armed forces and have made sacrifices for and contributions to preserving American liberties and protecting its borders.  Additionally, the legislature finds that public memorials are an essential form of recognition and remembrance to honor United States veterans and military personnel who have served in and died as a result of war and conflict.

     The purpose of this Act is to appropriate moneys for plans and design of a memorial and replicas consistent with the purposes of Act 139, Session Laws of Hawaii 2013, and the Gulf War memorial task force 2014 report to the legislature.

     SECTION 2.  The director of finance is authorized to issue general obligation bonds in the sum of $           or so much thereof as may be necessary and the same sum or so much thereof as may be necessary is appropriated for fiscal year 2022-2023 as follows:

     (1)  $           for plans; and

     (2)  $           for design,

for the purpose of constructing a memorial honoring veterans of the Persian Gulf War, Operation Desert Storm, Operation Iraqi Freedom, Operation Enduring Freedom, Operation New Dawn, Global War on Terrorism, Homeland Defense, and Operation Noble Eagle, and those who have protected our borders by land, sea, and air; and for construction of replicas of the memorial on each neighbor island, as recommended by the Gulf War memorial task force pursuant to Act 139, Session Laws of Hawaii 2013, in its 2014 report to the legislature.

     The sum appropriated shall be expended by the office of veterans services for the purposes of this Act.

     SECTION 3.  The appropriation made for the capital improvement project authorized by this Act shall not lapse at the end of the fiscal biennium for which the appropriation is made; provided that all moneys from the appropriation unencumbered as of June 30, 2025, shall lapse as of that date.

     SECTION 4.  This Act shall take effect on July 1, 2022.
