A BILL FOR AN ACT

 

 

relating to the budget.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 37, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§37-     Budget acts; conflicts with statutory provisions; budget prevails.  Notwithstanding any other law to the contrary, and except as provided in section 37-37, if any state statute relating to budget allocations, transfers, or restrictions, or the establishment, transfer, or abolition of positions or powers or duties related thereto is in conflict with or contradictory to provisions or directives of the budget passed legislatively and enacted into law for the fiscal year:

     (1)  The budget shall prevail;

     (2)  The governor shall execute the provisions of the budget; and

     (3)  The governor shall report the actions taken to the legislature within thirty days of the enactment of the budget."


     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect on June 30, 2010.


 


 

Report Title:

State Budget; Conflict with Statutory Provision

 

Description:

Establishes that the budget shall prevail over statutory law whenever they are in conflict, unless there is an underestimation of state tax revenues.  Requires the governor to execute the provisions of the budget and report any action taken to the legislature within thirty days of the enactment of the budget.  (SD1)
