A BILL FOR AN ACT

 

 

RELATING TO THE HAWAII STATE HOSPITAL.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that the Hawaii state hospital is the only publicly funded state psychiatric hospital in the State.  The hospital is organized within the adult mental health division of the department of health, and provides adult inpatient psychiatric services.  The Hawaii State Hospital is accredited by The Joint Commission, most recently in December 2021, for thirty-six months, and is licensed as a healthcare facility by the office of health care assurance of the department of health.

     The legislature further finds that following a tragic incident on Hawaii state hospital grounds, the department of health conducted a comprehensive safety review.  As a result, a series of quality improvement recommendations were made to increase oversight of safety and security, enhance safety and security measures, and decrease hospital census, such as by increasing mental health provider reimbursement, expanding the number of group homes, and increasing the number of forensic psychologists to perform court evaluations.

     The purpose of this Act is to appropriate funds to the department of health to implement these quality improvement recommendations for the Hawaii state hospital.

     SECTION 2.  In accordance with section 9 of article VII of the Hawaii State Constitution and sections 37-91 and 37-93, Hawaii Revised Statutes, the legislature has determined that the appropriations contained in Act 164, Regular Session of 2023, and this Act will cause the state general fund expenditure ceiling for fiscal year 2024-2025 to be exceeded by $           or       per cent.  This current declaration takes into account general fund appropriations authorized for fiscal year 2024-2025 in Act 164, Regular Session of 2023, and this Act only.  The reasons for exceeding the general fund expenditure ceiling are that:

     (1)  The appropriation made in this Act is necessary to serve the public interest; and

     (2)  The appropriation made in this Act meets the needs addressed by this Act.

     SECTION 3.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2024-2025 to implement quality improvement measures recommended in the comprehensive safety review for the Hawaii state hospital, including:

     (1)  $           for       full-time equivalent (     FTE) positions; and

     (2)  $           for service contracts and provider reimbursement.

     The sum appropriated shall be expended by the department of health for the purposes of this Act.

     SECTION 4.  This Act shall take effect on July 1, 2024.
