A BILL FOR AN ACT

 

 

RELATING TO MOTOR VEHICLE INSPECTIONS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that the procedure for adjusting state motor carrier vehicle safety inspection fees requires updating because the current procedure is inefficient, requiring legislation to be passed every time an inspection fee is adjusted.

     The purpose of this Act is to provide the director of transportation with greater authority over the motor carrier vehicle safety inspection program by authorizing the director to adjust the cost to a vehicle owner for an inspection and the fees collected from inspection stations, and to alter the administration of the program by amending administrative rules pursuant to chapter 91, Hawaii Revised Statutes.

     SECTION 2.  Section 286-209, Hawaii Revised Statutes, is amended by amending subsections (b), (c), and (d) to read as follows:

     "(b)  The director shall adopt rules pursuant to chapter 91 for the administration and enforcement of motor carrier vehicle safety inspections, including the maximum inspection fee that a motor carrier vehicle inspection station may charge a vehicle owner, the fees collected from motor carrier vehicle inspection stations, the issuance of certificates of safety inspection, the affixing of motor carrier vehicle safety inspection [decals,] stickers, and the acceptance of certificates of safety inspection issued in other jurisdictions.

     (c)  The director shall collect a fee of $1.50 for each motor carrier vehicle safety inspection [decal] sticker issued by motor carrier vehicle inspection stations[.], until fees established by administrative rules pursuant to subsection (b) are adopted, at which time the fees provided for in the administrative rule shall apply.  All moneys [collected] received by the department of transportation pursuant to this section shall be [paid] deposited into the state highway fund.

     (d)  A fee of no more than $12 shall be charged by a motor carrier vehicle inspection station for each safety inspection performed[.], until fees established by administrative rules pursuant to subsection (b) are adopted, at which time the fees provided for in the administrative rule shall apply."

     SECTION 3.  Section 286-210, Hawaii Revised Statutes, is amended to read as follows:

     "§286-210  Operation of a motor carrier vehicle without a safety inspection [decal.] sticker.  Whoever operates, permits the operation of, causes to be operated, or parks any motor carrier vehicle on a public highway without a current motor carrier vehicle safety inspection [decal,] sticker, issued under section 286-209, shall be fined $100 for each day of the violation."

     SECTION 4.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun, before its effective date.

     SECTION 5.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 6.  This Act shall take effect on July 1, 2050.
