A BILL FOR AN ACT
RELATING TO MAUI'S PERMANENT HOUSING RECOVERY.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
Accordingly, the purpose of this Act is to ensure that the State has a unified vision and approach toward the development and redevelopment of public lands on the island of Maui by:
(1) Designating the Hawaii housing finance and development corporation as the lead agency to coordinate and advance housing development and redevelopment on state and county lands on Maui; and
(2) Establishing an interagency council for Maui housing recovery within the department of business, economic development, and tourism to coordinate effective and efficient housing development and redevelopment of state and county lands on Maui.
SECTION 2. Chapter 201H, Hawaii Revised Statutes, is amended by adding two new sections to part I to be appropriately designated and to read as follows:
"§201H-
Hawaii interagency
council for Maui housing recovery; established. (a) There is established the Hawaii interagency
council for Maui housing recovery, which shall be an advisory body that shall:
(1) Coordinate and facilitate Maui's
permanent housing recovery; and
(2) Facilitate consultation and
collaboration between the State and the county of Maui on housing recovery
initiatives.
The Hawaii interagency council for Maui
housing recovery shall be established within the department of business,
economic development, and tourism for administrative purposes.
(b) The Hawaii interagency council
for Maui housing recovery shall:
(1) Serve as the State's primary Maui
housing recovery planning and policy development entity, with representation
from the state and county governments and the community;
(2) Formulate a strategic plan to
address Maui's housing recovery projects, including mixed-use, affordable, and
rental housing projects on Maui's state and county lands, and advise the
governor and the mayor of the county of Maui on the implementation of the
strategic plan;
(3) Facilitate the acquisition of
funding and resources for state and county housing recovery programs, including
affordable and rental housing projects on Maui's state and county lands;
(4) Monitor the preparation and
administration of plans and studies relating to state and county housing
recovery plans prepared pursuant to this section, including but not limited to
the preparation of site or master plans and implementation plans and studies;
(5) Review all capital improvement
project requests to the legislature for housing recovery projects, including
mixed-used, affordable, and rental housing projects, on Maui's state and county
lands;
(6) Recommend policy, regulatory, and
statutory changes, and identify resource strategies for the successful
execution of the strategic plan described in paragraph (2);
(7) Assemble accurate fiscal and
demographic information to support policy development and track outcomes;
(8) Consider collaborative housing
recovery initiatives in other states that have demonstrated positive outcomes;
(9) To the greatest extent possible, work with Maui-based businesses; and
(10) Report annually to the governor, the
legislature, and the mayor of the county of Maui on the progress of its
activities, including formulation and progress on the strategic plan described
in paragraph (2), no later than twenty days prior to the convening of each
regular session of the legislature.
(c) The strategic plan developed
by the Hawaii interagency council for Maui housing recovery shall:
(1) Provide for coordination with the
county on housing development;
(2) Compile an inventory of state,
county, and private sector housing projects that lack infrastructure; identify
the type of infrastructure each project lacks; and provide the approximate
timeframe when additional infrastructure capacity is needed;
(3) Prioritize the development and
redevelopment of housing recovery projects, including mixed-use, affordable,
and rental housing projects on Maui's state and county lands;
(4) Identify financing for, and
prioritize state financing requests for, public infrastructure, facilities, and
service investments required to support housing recovery development, including
mixed-use, affordable, and rental housing projects; and
(5) Encourage and promote partnerships
between public and private entities to identify and secure affordable housing
options on state and county lands, including through renovation projects.
§201H- Hawaii
interagency council for Maui housing recovery; membership. (a) The Hawaii interagency council for Maui
housing recovery shall be composed of the following members, who shall not be
subject to section 26-34:
(1) The executive director of the Hawaii
housing finance and development corporation, who shall serve as chair;
(2) The chairperson of the Hawaiian
homes commission, who shall serve as co-vice chair;
(3) The executive director of the Hawaii
public housing authority, who shall serve as co-vice chair;
(4) The chief of staff, office of the
governor;
(5) The director of finance;
(6) The director of business, economic
development, and tourism;
(7) The director of the office of
planning and sustainable development;
(8) The chairperson of the board of land
and natural resources;
(9) The chairperson of the board of
agriculture;
(10) The director of transportation;
(11) The comptroller;
(12) The director of health;
(13) The director of human services;
(14) The executive director of the school
facilities authority;
(15) The superintendent of education;
(16) The executive director of the Hawaii
community development authority;
(17) The chairperson of the senate
standing committee having primary jurisdiction over housing;
(18) The chairperson of the house of
representatives standing committee having primary jurisdiction over housing;
(19) The vice chairperson of the senate
standing committee having primary jurisdiction over housing;
(20) The vice chairperson of the house of
representatives standing committee having primary jurisdiction over housing;
(21) The state disaster recovery coordinator
and the recovery support functions identified by the governor, with their
corresponding state leads;
(22) The mayor of the county of Maui;
(23) The director of environmental
management of the county of Maui;
(24) The director of finance of the
county of Maui;
(25) The director of fire and public
safety of the county of Maui;
(26) The director of housing and human
concerns of the county of Maui;
(27) The director of planning of the
county of Maui;
(28) The director of public works of the
county of Maui;
(29) The director of transportation of
the county of Maui;
(30) The director of water supply of the
county of Maui;
(31) A Hawaiian cultural advisor who
shall be invited to serve by the governor as a non-voting member;
(32) Two representatives of the Maui
community who shall be invited to serve by the governor; provided that one
member shall represent the community of Lahaina;
(33) One member of the Maui county
council to be designated by the chairperson of the Maui county council;
provided that the chairperson of the council may designate a second member of
the council to serve as an alternate;
(34) A representative of the Honolulu
field office of the United States Department of Housing and Urban Development,
who shall be invited to serve by the governor as a non-voting member;
(35) A representative of the Hawaii field
office of the United States Department of Agriculture, Rural Development, who
shall be invited to serve by the governor as a non-voting member;
(36) A representative of the Honolulu
field office of the United States Small Business Administration, who shall be
invited to serve by the governor as a non-voting member;
(37) A representative of the Maui
business community, who shall be invited to serve by the governor;
(38) A representative of the Maui
community who is a housing advocate, who shall be invited to serve by the
governor; and
(39) A representative of the Maui
community having experience in housing and real estate development, who shall
be invited to serve by the governor.
(b) The nongovernmental members of
the Hawaii interagency council for Maui housing recovery shall serve without
compensation but shall be reimbursed for reasonable expenses, including
reasonable travel expenses, necessary for the performance of their duties.
(c) Except as provided in
subsection (a)(32), if a member of the Hawaii interagency council for Maui
housing recovery is unable to attend a meeting, that member may appoint a
designee to attend and to act on the member's behalf during the meeting."
SECTION 3. In accordance with section 9 of article VII, of the Constitution of the State of Hawaii and sections 37-91 and 37-93, Hawaii Revised Statutes, the legislature has determined that the appropriation contained in this Act will cause the state general fund expenditure ceiling for fiscal year 2024-2025 to be exceeded by $ , or per cent. The reasons for exceeding the general fund expenditure ceiling are that the appropriation made in this Act is necessary to serve the public interest and to meet the need provided for by this Act.
SECTION 4. There is appropriated out of the general revenues of the State of Hawaii the sum of $500,000 or so much thereof as may be necessary for fiscal year 2024-2025 to carry out the purposes of this Act and to assist the state and Maui county agencies in applying for federal loans and grants.
The sum appropriated shall be expended by the department of business, economic development, and tourism for the purposes of this Act.
SECTION 5. New statutory material is underscored.
SECTION 6. This Act shall take effect on July 1, 2024, and shall be repealed on June 30, 2034.
