A BILL FOR AN ACT

 

 

RELATING TO SCHOOLS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to part VI, subpart A to be appropriately designated and to read as follows:

     "§302A‑    Sale of soft drinks in vending machines prohibited.  (a)  No soft drink shall be sold in a public school vending machine.

     (b)  For the purposes of this section, the following terms shall have the following meanings:

     "Soft drink" means a nonalcoholic beverage that contains natural or artificial sweeteners, including carbonated and noncarbonated beverages, and not including beverages that contain milk or milk products, soy, rice, or similar milk substitutes, or greater than fifty per cent of vegetable or fruit juice by volume.

     "Vending machine" means any self-service device offered for public use which, upon insertion of a coin, token, or other form of payment, dispenses unit servings of food or beverage either in bulk or in package, without the necessity of replenishing the device between each dispensation."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval and shall apply to contracts for vending services executed or renewed on or after that date.
