A BILL FOR AN ACT

 

 

relating to university districts.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that the current zoning districts do not provide an applicable designation appropriate for the zoning of parcels containing university and college campuses.  In addition to educational functions, such as learning and research programs and facilities, university and college campuses generally include a variety and mix of other uses that serve the university or college community and enhance the overall educational experience provided by a university or college.

     The purpose of this Act is to authorize the University of Hawaii to establish university districts to provide greater flexibility in establishing a mixture of uses that are intended to enhance the campus environment of a university or college and accommodate its academic and spatial needs.

     SECTION 2.  Chapter 304A, Hawaii Revised Statutes, is amended by adding a new part to be appropriately designated and to read as follows:

"Part    .  university districts

     §304A-    Purpose.  The university district shall apply to areas of land that are utilized for campus-related activities and is intended to apply to areas for the location and expansion of universities and the uses and facilities that are associated with and are supportive of them.  Special consideration of such uses and facilities are appropriate given the unique characteristics of university areas, the variety of uses needed to serve the university community, and the varying intensity of land uses in such a community.  The purpose of this part is to:

     (1)  Establish standards governing the development, construction, and use of specific buildings and structures on the university campus for purposes pertaining to the overall enhancement of the campus community and academic achievement;

     (2)  Control the organization and design of use and structures to assure that the development will not detract from the natural environmental features and attributes of the surrounding area;

     (3)  Establish the level of minimum services necessary to supplement the campus community as well as any current students, faculty, and other community members residing on campus; and

     (4)  Maintain the character of the campus communities within the university districts, as well as the communities in neighborhoods adjacent to the university districts.

     §304A-    University district development rules.  The University of Hawaii shall establish university district rules under chapter 91 on health, safety, building, planning, zoning, and land use which shall supersede all other inconsistent ordinances and rules relating to the use, zoning, planning, and development of land and construction thereon.  Rules adopted under this section shall follow existing law, rules, ordinances, and regulations as closely as is consistent with standards meeting minimum requirements of good design, pleasant amenities, health, safety, and coordinated development."

     SECTION 3.  This Act shall take effect on July 1, 2018.
