A BILL FOR AN ACT
RELATING TO ENVIRONMENTAL DUE DILIGENCE.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. There is appropriated out of the general revenues of the State of Hawaii the sum of $ or so much thereof as may be necessary for fiscal year 2018-2019 for the department of land and natural resources to conduct a phase I environmental site assessment and, if necessary, a phase II environmental site assessment and suitable environmental remediation at the former Lalamilo reservoir site on the island of Hawaii as due diligence to include any common transaction costs, including but not limited to:
(1) Phase I and phase II environmental site assessments, and any subsequent environmental site remediation, abatement, and disposal, as may be warranted;
(2) Site planning, consultant fees, title reports, and title insurance;
(3) Any appraisal costs, land surveys, maps, and descriptions;
(4) Any entitlement or encumbrance costs, escrow fees, and recordation fees;
(5) Costs of any public notification, including public notice pursuant to section 171-16, Hawaii Revised Statutes; and
(6) Any other necessary transaction fees, concerning the Lalamilo reservoir site land exchange transaction, which includes the state parcel to be conveyed by the State and the private land to be acquired by the State for the relocation of a public library.
The sum appropriated shall be expended by the department of land and natural resources for the purposes of this Act.
SECTION 2. This Act shall take effect on July 1, 2050.

Makes an appropriation for the Department of Land and Natural Resources to conduct a phase I environmental site assessment and, if necessary, a phase II environmental site assessment and suitable environmental remediation at the former Lalamilo reservoir site on the island of Hawaii as due diligence to include any common transaction costs concerning the Lalamilo reservoir site land exchange transaction for the relocation of a public library. Effective 7/1/2050. (SD2)
