A BILL FOR AN ACT

 

 

relating to the hawaii public housing authority.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that in December 2008, a class action lawsuit was filed against the Hawaii public housing authority alleging hazardous conditions and discriminatory obstacles at Kuhio park terrace and Kuhio homes in Kalihi, two of the largest and oldest public housing properties in the state.

     The legislature further finds that resolving these deficiencies in a timely manner will be difficult unless the Hawaii public housing authority is given more flexibility in expending repair and maintenance funding to correct the health and safety problems at Kuhio park terrace and Kuhio homes in Kalihi.

     The purpose of this Act is to provide a temporary exemption from chapter 103 and 103D, Hawaii Revised Statutes, to the Hawaii public housing authority in order to correct the health and safety deficiencies at Kuhio park terrace and Kuhio homes in Kalihi.

     SECTION 2.  (a)  Chapter 356D, Hawaii Revised Statutes, notwithstanding, the Hawaii public housing authority shall not be subject to chapter 103 and 103D, Hawaii Revised Statutes, and any and all other requirements of law for competitive bidding for construction contracts or other contracts related to correcting the health, safety, habitability, and accommodations for disabled resident deficiencies at Kuhio park terrace and Kuhio homes in Kalihi; provided that the authority shall develop internal policies and procedures for the procurement of goods, services, and construction, consistent with the goals of public accountability and public procurement practices.

     (b)  The authority shall submit annual reports to the legislature no later than twenty days prior to the convening of the regular sessions of 2010 through 2013 on the status of the projects to correct the deficiencies at Kuhio park terrace and Kuhio homes in Kalihi, pursuant to subsection (a).

     SECTION 3.  This Act shall take effect on July 1, 2009, and the exemption granted in section 2 of this Act shall be repealed on June 30, 2012.
