A BILL FOR AN ACT

 

 

Relating to capital improvement projects for THE REPAIR AND MAINTENANCE OF IRRIGATION SYSTEMS WITHIN THE STATE.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  A reliable irrigation system is the lifeblood of Hawaii's agricultural industry.  To ensure that Hawaii's crops receive a steady and dependable supply of water, sufficient funding is needed to maintain and improve Hawaii's irrigation systems.

     The purpose of this Act is to appropriate funds for capital improvement projects for irrigation systems throughout the State.

     SECTION 2.  The director of finance is authorized to issue general obligation bonds in the sum of $           or so much thereof as may be necessary and the same sum or so much thereof as may be necessary is appropriated for fiscal year 2009-2010 for the purpose of funding capital improvement projects for irrigation systems throughout the State, as follows:

     (1)  Repair, maintenance, and salaries for additional employees of the Agricultural Resource Management Division, for the repair, maintenance, and support of the following irrigation systems:

          (A)  Maui:

              (i)  West Maui                       $          

              (ii)  Upcountry Maui                  $         ;

          (B)  Molokai                              $         ;

          (C)  Hawaii:

              (i)  Lower Hamakua                   $          

              (ii)  Kau                             $          

             (iii)  Waimea                          $         ;

          (D)  Kauai:

              (i)  East Kauai                      $          

              (ii)  west Kauai                      $         ;

          (E)  Oahu:

              (i)  Kahuku agricultural park        $          

              (ii)  Waimanalo                       $         ;

          and

     (2)  $           for the development of the department of agriculture's agricultural water use and development plan, mandated by Act 101, Session Laws of Hawaii 1998.

     SECTION 3.  The appropriation made for the capital improvement project authorized by this Act shall not lapse at the end of the fiscal biennium for which the appropriation is made; provided that all moneys from the appropriation unencumbered as of June 30, 2012, shall lapse as of that date.

     SECTION 4.  The sums appropriated for the respective capital projects set forth in section 2 shall be expended by the department of agriculture for the purposes of this Act.

     SECTION 5.  There is appropriated out of the irrigation repair and maintenance special fund under section 167-24, Hawaii Revised Statutes, the sum of $           or so much thereof as may be necessary for fiscal year 2009-2010 for the purposes of furthering the projects outlined in section 2 of this Act.  Any unexpended or unencumbered balance of any appropriation made by this section as of the close of business on June 30, 2010, shall lapse into the irrigation repair and maintenance special fund.

     The sum appropriated shall be expended by the department of agriculture for the purposes of this Act.

     SECTION 6.  This Act shall take effect on July 1, 2009.
