A BILL FOR AN ACT
relating to campaign fundraising.
BE IT
ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The legislature finds that campaign fundraising events held during legislative sessions diminish public trust, especially when legislators invite lobbyists who seek favorable treatment. This has led to proposals to prohibit these types of fundraisers.
The legislature further finds that instead of prohibiting campaign fundraisers during legislative sessions, a more feasible and fair approach is to increase public disclosure of fundraising events, which would increase transparency for both legislators and legislative challengers.
The purpose of this Act is to require incumbent legislators and legislative candidates to file a notice of intent to hold a fundraiser, for any requested amount, during legislative sessions.
SECTION 2. Section 11-342, Hawaii Revised Statutes, is amended to read as follows:
"[[]§11-342[]] Fundraiser; notice of intent. (a) No
fundraiser shall be held unless a notice of intent to hold the fundraiser is
filed with the commission setting forth the name and address of the person in
charge, the price per person, the date, hour, and place of the fundraiser, and
the method thereof.
(b) The person in charge of the fundraiser shall file the notice with the commission prior to the fundraiser.
(c) Notwithstanding subsection (d), incumbent legislators
and candidates for legislative office shall file a notice of intent pursuant to
this section for any function, regardless of the price or suggested contribution
amount, that otherwise meets the definition of "fundraiser", held during
a regular or special session of the legislature.
[(c)] (d) As used in this section, "fundraiser"
means any function held for the benefit of a candidate, candidate committee, or
noncandidate committee that is intended or designed, directly or indirectly, to
raise contributions for which the price or suggested contribution for attending
the function is more than $25 per person."
SECTION 3. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.
