A BILL FOR AN ACT

 

 

relating to agricultural land.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


PART I

     SECTION 1.  The legislature finds that Act 119, Session Laws of Hawaii 2015, as amended and renumbered by Act 124, Session Laws of Hawaii 2016, appropriated, in item A-8.03 of section 47, $31,500,000 in general obligation bond funds to acquire various agricultural lands.  Pursuant to section 90 of Act 119, unencumbered funds for capital improvement project appropriations for that biennium lapsed on June 30, 2018.  However, pursuant to authority granted to the department of accounting and general services by the State of Hawaii accounting manual, volume I, part 400, the lapse date for the item A-8.03 appropriation was extended to June 30, 2019.

     The legislature further finds that the State requires an additional year to complete the purchase authorized by item A‑8.03.

     The purpose of this part is to extend the lapse date of the appropriation made by item A-8.03 by one year.

     SECTION 2.  Act 119, Session Laws of Hawaii 2015, as amended and renumbered by Act 124, Session Laws of Hawaii 2016, is amended by amending section 90 to read as follows:

     "SECTION 90.  Any provision of this Act to the contrary notwithstanding, the appropriations made for capital improvement projects authorized under this Act shall not lapse at the end of the fiscal biennium for which the appropriation is made; provided that all appropriations made to be expended in fiscal biennium 20152017 which are unencumbered as of June 30, 2018, shall lapse as of that date; and provided further that this lapsing date shall not apply to:

     (1)  Appropriations for projects where the means of funding is the state educational facilities improvement special fund, where such appropriations have been authorized for more than three years for the construction or acquisition of public school facilities; [and]

     (2)  Nongeneral fund appropriations for projects described in section 47 of this Act where such appropriations have been deemed necessary to qualify for federal aid financing and reimbursement and are unencumbered as of June 30, 2022, shall lapse as of that date[.]; and

     (3)  The non-general fund appropriations in item A-8.03. of section 47 of this Act that are unencumbered as of June 30, 2020, shall lapse as of that date."

PART II

     SECTION 3.  Part IV, Act 49, Session Laws of Hawaii 2017, as amended and renumbered by Act 53, Session Laws of Hawaii 2018, is amended by amending Item A-17.01 to read as follows:

"17.01.     AGRICULTURAL LAND, OAHU

 

        PLANS, ACQUISITION [OF EASEMENTS FOR DEEP WELLS AND ACQUISITION] OF LANDS ON OAHU: TMK [6-5-002-006; 6-5-002-008; 6-5-002-027; 6-5-002-028 IN KAMANANUI, OAHU, AND DESIGN FOR DEEP WELLS AND LAND ACQUISITIONS FOR CULTIVATION AND IRRIGATION OF GALBRAITH, KAMANANUI, AND PAALAA UKA LANDS.] 6-5-001-004; 6-5-001-014, AND PLANS AND ACQUISITION OF EASEMENTS FOR DEEP WELLS ON OAHU: TMK 6-4-003-022.

     SECTION 4.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect on June 29, 2019.

Description:
