A BILL FOR AN ACT
relating to water pollution.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The legislature finds that the quality of water that enters Hawaii's drainage systems directly impacts the State's health. Water that enters storm drain outlets flows untreated to the State's waterways and ocean.
The legislature recognizes that population growth and the development of urbanized areas are major contributors to the pollutants in runoff water. These pollutants can threaten aquatic life, increase flooding, and cause higher rates of coastal erosion.
The legislature finds that some coastal cities have installed netting over storm drains to prevent floating solids, trash, and debris from entering natural water systems.
Accordingly, the purpose of this Act is to require the department of health clean water branch to study the feasibility of implementing pollution netting technology on the State's storm water drainage systems.
SECTION 2. (a) The department of health clean water branch shall establish a working group and conduct a study to determine the feasibility of purchasing and deploying pollution netting technology on the State's storm water drainage systems.
(b) The working group shall include a representative from each county having a National Pollutant Discharge Elimination System permit.
(c) The working group shall submit a report of its
findings and recommendations, including any proposed legislation, to the
legislature no later than twenty days prior to the convening of the regular
session of 2022.
(d) The working group shall cease to exist upon adjournment sine die of the regular session of 2022.
SECTION 3. There is appropriated out of the general revenues of the State of Hawaii the sum of $ or so much thereof as may be necessary for fiscal year 2021-2022 and the same sum or so much thereof as may be necessary for fiscal year 2022-2023 to fund a working group and study on the feasibility of purchasing and deploying pollution netting technology on the State's storm water drainage systems.
The sums appropriated shall be expended by the department of health clean water branch for the purposes of this Act.
SECTION 4. This Act shall take effect on July 1, 2021.
