A BILL FOR AN ACT
relating to information sharing.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Information created and maintained by the State is public property for the benefit of Hawaii's residents. A cooperative culture among departments and agencies will encourage responsible sharing of information and the removal of barriers preventing departments from obtaining necessary data. Proper procedures for sharing information will maximize departmental knowledge while balancing the need for security and privacy of non-public information.
The legislature finds that creating an environment to increase the sharing of information among departments and agencies will benefit the State and its citizens by improving decision-making, supporting business process improvement, reducing redundancy, minimizing errors, and creating a more responsive service to the needs of citizens.
SECTION 2. Chapter 27, Hawaii Revised Statutes, is amended by adding a new section to part VII to be appropriately designated and to read as follows:
"§27- Department and agency sharing of information to improve government operations. (a) Departments and agencies shall share information to improve government operations, except as prohibited by state and federal law.
(b) The chief information officer shall oversee the sharing of information among departments and agencies and shall develop policies, procedures, processes, and direct paperless initiatives necessary to effectuate this section, including:
(1) The time and manner of disclosing information;
(2) The disclosure and nondisclosure of confidential information protected by federal or state law; and
(3) The policies and procedures a disclosing department or agency may use to prevent a recipient department or agency from redistributing information.
(c) Departments and agencies may:
(1) Share information without entering into a written agreement; and
(3) Retain custodial ownership of any information provided to other departments or agencies.
(d) Information shall be shared using appropriate information security protocols, established by the chief information officer, to ensure that the information will be accessible only by authorized personnel."
SECTION 3. There is appropriated out of the general revenues of the State of Hawaii the sum of $ or so much thereof as may be necessary for fiscal year 2013-2014 and the same sum or so much thereof as may be necessary for fiscal year 2014-2015 for departments and agencies to share information to improve government operations.
The sums appropriated shall be expended by the department of accounting and general services for the purposes of this Act.
SECTION 4. New statutory material is underscored.
SECTION 5. This Act shall take effect on July 1, 2013.
