SENATE CONCURRENT

RESOLUTION

 

 

Encouraging all public and private employers in this state to use e-verify to confirm employee workplace eligibility.

 

 


     WHEREAS, it has been widely reported that many jobs intended for United States citizens have been occupied by illegal aliens; and

 

     WHEREAS, E-Verify is a free internet-based system that is operated by the Department of Homeland Security, in partnership with the Social Security Administration, that allows an employer, using information supplied by the employee on their Employment Eligibility Verification Form I-9, to determine the eligibility of that employee to work in the United States; and

 

     WHEREAS, E-Verify has an extraordinary success rate in identifying illegal workers without resulting in an undue burden on employers or selecting employees to be verified in an unlawful manner; and

 

     WHEREAS, the use of E-Verify has been successful in enabling the employers who utilize E-Verify to prevent 2.8 per cent of the employees they initially choose to hire from working in the United States, and this 2.8 figure likely represents the percentage of workers who are not eligible to work in the United States; and

 

     WHEREAS, currently, only twenty-five per cent of all of the new hires in the United States are being verified for eligibility to work in the United States with E-Verify; and

 

     WHEREAS, the use of E-Verify, other than for employers with federal contracts or subcontracts on or after September 8, 2009, that contain the Federal Acquisition Regulation E-Verify clause and employers in certain states, is voluntary; and

 

     WHEREAS, many of the vacant jobs intended for residents of Hawaii have illegal aliens competing for the same jobs; and

 

     WHEREAS, the use of E-Verify in this State would help to ensure, especially during the current economic recession, that no jobs for Hawaii residents are lost to illegal aliens; now, therefore,

 

     BE IT RESOLVED by the Senate of the Twenty-fifth Legislature of the State of Hawaii, Regular Session of 2010, the House of Representatives concurring, that all public and private employers in this State are encouraged to utilize E-Verify to confirm workplace eligibility when hiring employees; and

 

     BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Governor of the State of Hawaii, the Auditor, the Director of Business, Economic Development, and Tourism, the Director of Commerce and Consumer Affairs, the Director of Human Resources Development, the Director of Labor and Industrial Relations, and the mayors of the respective counties.
