SENATE CONCURRENT
RESOLUTION
Requesting the Department of Accounting and general services to ensure sole authority over disbursements and issuance of checks from the Tourism Special fund.
WHEREAS, the tourism special fund was established by Act 156, Session Laws of Hawaii 1998; and
WHEREAS, under Act 156, Session Laws of Hawaii 1998, the tourism special fund was established within the state treasury; and
WHEREAS, Act 235, Session Laws of Hawaii 2005, repealed language establishing the tourism special fund within the state treasury and, in turn, gave the Hawaii Tourism Authority the ability to issue checks from the tourism special fund; and
WHEREAS, Act 102, Session Laws of Hawaii 2010, reenacted language providing that the tourism special fund is established within the state treasury effective June 30, 2015; and
WHEREAS, as of June 30, 2015, the Hawaii Revised Statutes state that the tourism special fund is established within the state treasury and, thus, the Hawaii Tourism Authority should no longer have the ability to issue checks from the tourism special fund; and
WHEREAS, the Department of Accounting and General Services currently disburses funds and issues checks for various state agencies and departments with special funds established within the state treasury; now, therefore,
BE IT RESOLVED by the Senate of the Twenty-ninth Legislature of the State of Hawaii, Regular Session of 2017, the House of Representatives concurring, that the Department of Accounting and General Services, Department of Budget and Finance, and Attorney General are requested to ensure that the Department of Accounting and General Services has the sole authority to issue checks from the tourism special fund; and
BE IT FURTHER RESOLVED that the Department of Accounting and General Services, Department of Budget and Finance, and Attorney General are requested to provide proposed legislation, including any necessary conforming amendments to the Hawaii Revised Statutes, no later than twenty days prior to the convening of the Regular Session of 2018 that reestablishes the tourism special fund within the state treasury; and
BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Attorney General, Comptroller, and Director of Finance.
