SENATE CONCURRENT

RESOLUTION

 

 

REQUESTING THE DEPARTMENT OF LAND AND NATURAL RESOURCES TO DEVELOP RECOMMENDATIONS FOR INCREASED FEES TO HELP SUPPORT A FULLY STAFFED STATE HISTORIC PRESERVATION DIVISION PROGRAM.

 

 


     WHEREAS, pursuant to section 13-282-4, Hawaii Administrative Rules, the fee for an archaeological permit application is $50; and

 

     WHEREAS, pursuant to section 13-284-4, Hawaii Administrative Rules, the fees range from $25 to $450 for various historic preservation reviews; and

 

     WHEREAS, pursuant to section 13-275-4, Hawaii Administrative Rules, filing fees for reviews of reports and plans for governmental projects also range from $25 to $450; and

 

     WHEREAS, these fees have not been increased in many years; and

 

     WHEREAS, in recent years, the State Historic Preservation Division has faced a growing workload, while dealing with reductions in personnel and budget cuts; and

 

     WHEREAS, an analysis of the required activities undertaken by the State Historic Preservation Division indicates that significant regulatory costs are derived from the review of documents, reports, and plans, and to a lesser degree from issuing annual permits; and

 

     WHEREAS, the Legislature believes that consideration should be given to reasonable increases in the fees charged by the State Historic Preservation Division in compliance with chapter 6E, Hawaii Revised Statutes; and

 

     WHEREAS, in order to determine fee increases that are realistic but not prohibitive, actual data is necessary to support any such fee increases; now, therefore,

 

     BE IT RESOLVED by the Senate of the Twenty-sixth Legislature of the State of Hawaii, Regular Session of 2012, the House of Representatives concurring, that the Department of Land and Natural Resources is requested to develop recommendations for increased fees to help support a fully staffed State Historic Preservation Division program; and

 

     BE IT FURTHER RESOLVED that the Department of Land and Natural Resources is requested to develop the recommendations for increased fees with assistance from the Society for Hawaiian Archaeology, Historic Hawaii Foundation, advocates of historic preservation, and other interested parties; and

 

     BE IT FURTHER RESOLVED that the Department of Land and Natural Resources is requested to pursue its recommended fee increases to partially defray the costs of administering sections 6E-3(13), 6E-8, and 6E-42, Hawaii Revised Statutes, through amendments to rules adopted pursuant to chapter 91, Hawaii Revised Statutes; and

 

     BE IT FURTHER RESOLVED that the Department of Land and Natural Resources is requested to report its findings and recommendations to the Legislature no later than twenty days prior to the convening of the Regular Session of 2013, including:

 

     (1)  Statistics on the numbers and types of documents currently reviewed, the fees received over the last three years, and rough estimates of staff time required; and

 

     (2)  The status of any amendments to the Department's Hawaii Administrative Rules; and

 

     BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Chairperson of the Board of Land and Natural Resources, the President of the Board of Directors of the Society for Hawaiian Archaeology, and the Executive Director of the Historic Hawaii Foundation.
