SENATE CONCURRENT

RESOLUTION

 

 

requesting the department of health to establish fees through the rulemaking process for the licensure, certification, and recertification of various facilities seeking licensure or certification by the department.

 

 


     WHEREAS, the Department of Health is responsible for establishing fees for licensing and certification of health care facilities in the State; and

 

     WHEREAS, pursuant to section 321-11.5, Hawaii Revised Statutes, the Department of Health may establish reasonable fees for the issuance or renewal of licenses, permits, variances, and various certificates required by law or by the Department's rules; and

 

     WHEREAS, currently, health care facilities do not pay any licensing fee, even though health care professionals and other professionals are subject to certain licensing fees; and

 

     WHEREAS, the establishment of fees will produce fee revenue that will directly support the Department of Health's licensing and certification program; now, therefore,

 

     BE IT RESOLVED by the Senate of the Twenty-eighth Legislature of the State of Hawaii, Regular Session of 2016, the House of Representatives concurring, that the Department of Health is requested to establish fees through the rulemaking process, pursuant to chapter 91, Hawaii Revised Statutes, for the licensure, relicensure, certification, and recertification of the following facilities:

 

     (1)  Adult residential care homes;

 

     (2)  Expanded adult residential care homes;

 

     (3)  Developmental disabilities domiciliary homes;

 

     (4)  Community care foster family homes;

 

     (5)  Adult day care centers; and

 

     (6)  Adult foster homes for developmentally disabled individuals; and

 

     BE IT FURTHER RESOLVED that the Department of Health is requested to submit a report to the Legislature no later than twenty days prior to the convening of the Regular Session of 2017 on the status of the establishment of fees for licensure, relicensure, certification, and recertification of the various facilities seeking licensure, relicensure, certification, or recertification by the Department; and

 

     BE IT FURTHER RESOLVED that a certified copy of this Concurrent Resolution be transmitted to the Director of Health.
