SENATE RESOLUTION

 

 

requesting measures to expedite procedures in the land court and reduce the backlog of cases.

 

 


     WHEREAS, the Bureau of Conveyances (Bureau) is responsible for maintaining a permanent record system for the receipt of deeds, plans, maps, and any and all instruments and documents that relate to or are connected with any interest in real property within the State; and

 

     WHEREAS, the Bureau, which includes the Regular System and the Land Court, was investigated in 2007 by a Joint Senate-House Investigative Committee, pursuant to Senate Concurrent Resolution No. 226; and

 

     WHEREAS, the joint Senate-House Investigative Committee in 2007 found that the Land Court was a year-and-a-half behind in providing current and updated certificates of title; and

 

     WHEREAS, the Committee also found that the work backlog in respect to indexing documents and opening the Land Court mail was a long-standing problem at the Bureau; and

 

     WHEREAS, in 2009, the Legislature passed Act 120 to reduce the backlog at the Bureau; and

 

     WHEREAS, the Land Court system was designed to process single, consecutive ownership interests and not multiple, simultaneous interests in a single parcel of land, thus the development of time share interests was identified as a source of the considerable backlog; and

 

     WHEREAS, the measure removed time share interests from Land Court registration and authorized the Registrar at the Bureau to accept electronic documents for the Regular System; and

 

     WHEREAS, despite the Legislature's efforts in identifying the problems in the Bureau and the measures taken to resolve these problems, there remains a significant backlog in the Land Court; now, therefore,

 

     BE IT RESOLVED by the Senate of the Twenty-fifth Legislature of the State of Hawaii, Regular Session of 2010, that the Bureau is requested to take measures to expedite procedures in the Land Court and reduce the backlog of cases; and

 

                BE IT FURTHER RESOLVED that certified copies of this Resolution be transmitted to Chairperson of the Board of Land and Natural Resources and the Registrar of the Bureau of Conveyances.
