SENATE RESOLUTION

 

 

Urging the Governor to issue an executive order rescinding the terms of Executive order NO. 107 for the purpose of selling parcel 107 to the board of water supply.

 

 


     WHEREAS, the Governor of the Territory of Hawaii, Charles James McCarthy, issued Executive Order No. 107 on June 28, 1921; and

 

     WHEREAS,  Executive Order No. 107 set aside 50,548 square feet of public land, Parcel 107, to the City and County of Honolulu for the limited purpose of constructing and operating a water pumping station and municipal garage along Beretania Street and Alapai Street on the island of Oahu; and

 

     WHEREAS, in 1929, the Territorial Legislature enacted Act 96, creating the Honolulu Board of Water Supply and transferring to the Board the function of providing water to the residents of the City and County of Honolulu; and

 

     WHEREAS, rescinding the terms of Executive Order No. 107 and conveying Parcel 107 to the Honolulu Board of Water Supply would enable the Board to consolidate and redevelop the parcels at the Beretania Street location to the benefit of ratepayers; and

 

     WHEREAS, section 171-95(a)(1), Hawaii Revised Statutes, authorizes the Board of Land and Natural Resources to sell public lands to governments, including the United States, city and county, counties, and other governmental agencies authorized to hold lands in fee simple; now, therefore,

 

     BE IT RESOLVED by the Senate of the Twenty-sixth Legislature of the State of Hawaii, Regular Session of 2011, that the Governor is urged to issue an executive order rescinding the terms of Executive Order No. 107, with the stated purpose of conveying the fee simple interest in Parcel 107 to the Honolulu Board of Water Supply; and

 

     BE IT FURTHER RESOLVED that, upon the Governor's issuance of the executive order, the Board of Land and Natural Resources is urged to sell Parcel 107 to the Honolulu Board of Water Supply pursuant to section 171-95(a)(1), Hawaii Revised Statutes; and

 

     BE IT FURTHER RESOLVED that certified copies of this Resolution be transmitted to the Governor, the Chairperson of the Board of Land and Natural Resources, the Mayor of the City and County of Honolulu, and the Chairperson of the Honolulu Board of Water Supply.
