  1  1    Section 1.  Section 414.1, subsection 1, Code 2017, is
  1  2 amended to read as follows:
  1  3    1.  a.  For the purpose of promoting the health, safety,
  1  4 morals, or the general welfare of the community or for the
  1  5 purpose of preserving historically significant areas of
  1  6 the community, any city is hereby empowered to regulate and
  1  7 restrict the height, number of stories, and size of buildings
  1  8 and other structures, the percentage of lot that may be
  1  9 occupied, the size of yards, courts, and other open spaces, the
  1 10 density of population, and the location and use of buildings,
  1 11 structures, and land for trade, industry, residence, or other
  1 12 purposes.
  1 13    b.  A city shall not, after January 1, 2018, adopt or enforce
  1 14 any regulation or restriction related to the occupancy of
  1 15 residential rental property that is based upon the existence
  1 16 of familial or nonfamilial relationships between the occupants
  1 17 of such rental property.
  1 18                           EXPLANATION
  1 19 The inclusion of this explanation does not constitute agreement with
  1 20 the explanation's substance by the members of the general assembly.
  1 21    This bill relates to the authority of cities to regulate and
  1 22 restrict the occupancy of residential rental property.
  1 23    The bill provides that a city shall not, after January 1,
  1 24 2018, adopt or enforce any regulation or restriction related
  1 25 to the occupancy of residential rental property based upon the
  1 26 familial or nonfamilial relationships of the occupants.
