H.F. 2015 Section 1. PROFESSIONAL LICENSING LEGISLATIVE INTERIM 1 COMMITTEE. 2 1. The legislative council is requested to establish a 3 legislative interim committee composed of five members of the 4 house of representatives and five members of the senate to meet 5 during the 2014 legislative interim, to study professional 6 licenses administered or supervised by the department of public 7 health. 8 2. The committee shall work in conjunction with the 9 department of public health to conduct a study of professional 10 licenses and evaluate the effects of such licensing on the 11 economy and on public health and safety. The study shall 12 include all of the following: 13 a. Identification of all professional licenses, 14 registrations, and certifications administered by the 15 department of public health. 16 b. A review of all regulations and continuing education 17 requirements for each license, registration, or certification 18 and a comparison of those regulations and requirements to other 19 states’ regulations and requirements for similar professions. 20 c. An evaluation of whether the requirements and 21 regulations for each profession are important in protecting 22 public health and safety or whether the requirements and 23 regulations are intended to address other issues. 24 d. A determination of whether the requirements and 25 regulations pertain to all licensees within the profession 26 or whether any licensees are exempt from the requirements or 27 regulations, as well as an evaluation of the possible reasons 28 for any exemptions or exceptions. 29 e. A determination of whether any regulation or requirement 30 is onerous to a particular professional. 31 f. A determination of whether specific professional 32 licenses, registrations, or certifications, or regulations, 33 requirements, or training for such licenses, registrations, 34 or certifications are necessary for public health and safety, 35 -1- LSB 5518HH (5) 85 ad/nh 1/ 2
H.F. 2015 recommendations on the elimination of certain professional 1 licenses, registrations, or certifications, or regulations, 2 requirements, or training for such licenses, registrations, or 3 certifications, other recommendations, and cost projections for 4 any recommendations. 5 g. Other information the committee deems relevant. 6 3. The committee shall submit its findings and 7 recommendations to the general assembly by January 15, 2015. 8 EXPLANATION 9 The inclusion of this explanation does not constitute agreement with 10 the explanation’s substance by the members of the general assembly. 11 This bill requests the legislative council to establish a 12 legislative interim committee to study professional licenses 13 administered or supervised by the department of public health 14 and the regulations and requirements for those licenses. 15 The bill directs the committee to work with the Iowa 16 department of public health (IDPH) to conduct a study of 17 professional licenses to evaluate the effects of licensing 18 on the economy and on public health and safety. The bill 19 states that the study must include all of the following: the 20 identification of all professional licenses, registrations, and 21 certifications administered or supervised by IDPH; a review 22 of regulations and training requirements for each license, 23 registration, or certification and a comparison to other 24 states; an evaluation of the rationale for the requirements 25 and regulations for each professional license; a review of 26 exceptions or exemptions from regulations and requirements for 27 professional licensure; a determination of the hardship of 28 regulations or requirements for the professional licensure; and 29 recommendations for elimination of regulations or requirements 30 for professional licensure, or the elimination of certain 31 professional licenses, registrations, or certifications. 32 The bill directs the committee to submit its findings to the 33 general assembly by January 15, 2015. 34 -2- LSB 5518HH (5) 85 ad/nh 2/ 2
