for

consumption.

2.
Section
137F.6,
subsection
1,
paragraph
g,
Code

2011,
is
amended
to
read
as
follows:

g.
For
a
farmers
market
where
potentially
hazardous
food

is
sold
or
distributed,
one
seasonal
annual
license
fee
of
one
9
hundred
dollars
for
each
vendor
on
a
countywide
basis.

Sec.
3.
EFFECTIVE
DATE.
This
Act,
being
deemed
of
immediate
11
importance,
takes
effect
upon
enactment.

EXPLANATION
13
This
bill
eliminates
a
requirement
that
a
license
to
14
operate
a
farmers
market
is
seasonal.
A
farmers
market
15
is
a
marketplace
which
operates
principally
as
a
common
16
market
for
fresh
fruits
and
vegetables
on
a
retail
basis
17
for
off-the-premises
consumption
(Code
section
137F.1(5)).

Farmers
markets
are
regulated
and
licensed
by
the
department
19
of
inspections
and
appeals
or
a
municipal
corporation
acting
20
under
agreement
with
the
department
(Code
sections
137F.3
and
21
137F.8).
A
farmers
market
is
considered
a
food
establishment
22
and
subject
to
a
license
fee
if
it
sells
potentially
hazardous
23
food
(Code
sections
137F.1(7)
and
137F.6(1)(g)).

The
bill
takes
effect
upon
enactment.
