AGRICULTURAL EDUCATION. 4 12 1. There is appropriated from the general fund of the state 4 13 to the department of agriculture and land stewardship for the 4 14 fiscal year beginning July 1, 2018, and ending June 30, 2019, 4 15 the following amount, or so much thereof as is necessary, to be 4 16 used for the purposes designated: 4 17 For purposes of allocating moneys to an Iowa association 4 18 affiliated with a national organization which promotes 4 19 agricultural education providing for future farmers: 4 20 .................................................. $12,5004 21 25,000 4 22 2. FARMERS WITH DISABILITIES PROGRAM. 4 30 1. There is appropriated from the general fund of the state 4 31 to the department of agriculture and land stewardship for the 4 32 fiscal year beginning July 1, 2018, and ending June 30, 2019, 4 33 the following amount, or so much thereof as is necessary, to be 4 34 used for the purposes designated: 4 35 For purposes of supporting a program for farmers with 5 1 disabilities: 5 2 .................................................. $65,0005 3 130,000 5 4 2. The moneys appropriated in subsection 1 shall be used for 5 5 the public purpose of providing a grant to a national nonprofit 5 6 organization with over 80 years of experience in assisting 5 7 children and adults with disabilities and special needs. The 5 8 moneys shall be used to support a nationally recognized program 5 9 that began in 1986 and has been replicated in at least 30 other 5 10 states, but which is not available through any other entity 5 11 in this state, and that provides assistance to farmers with 5 12 disabilities in all 99 counties to allow the farmers to remain 5 13 in their own homes and be gainfully engaged in farming through 5 14 provision of agricultural worksite and home modification 5 15 consultations, peer support services, services to families, 5 16 information and referral, and equipment loan services. 5 17 3. Notwithstanding section 8.33, moneys appropriated in 5 18 this section that remain unencumbered or unobligated at the 5 19 close of the fiscal year shall not revert but shall remain 5 20 available for expenditure for the purposes designated until the 5 21 close of the succeeding fiscal year. 5 22 Sec. 8. 2017 Iowa Acts, chapter 168, is amended by adding 5 23 the following new section: 5 24 NEW SECTION. SEC. 42A. FOREIGN ANIMAL DISEASES AFFLICTING 5 25 LIVESTOCK. There is appropriated from the general fund of the 5 26 state to the department of agriculture and land stewardship for 5 27 the fiscal year beginning July 1, 2018, and ending June 30, 5 28 2019, the following amount, or so much thereof as is necessary, 5 29 to be used for the purposes designated: 5 30 For deposit in the foreign animal disease preparedness and 5 31 response fund created in section 163.3B: 5 32 .................................................. $ 250,000 5 33 DIVISION II 5 34 DEPARTMENT OF AGRICULTURE AND LAND STEWARDSHIP 5 35 GENERAL WATER QUALITY INITIATIVE APPROPRIATION 6 1 GENERAL FUND 6 2 Sec. 9. 2017 Iowa Acts, chapter 168, section 43, is amended 6 3 to read as follows: 6 4 SEC. 43. WATER QUALITY INITIATIVE ==== GENERAL. 6 5 1. There is appropriated from the general fund of the state 6 6 to the department of agriculture and land stewardship for the 6 7 fiscal year beginning July 1, 2018, and ending June 30, 2019, 6 8 the following amount, or so much thereof as is necessary, to be 6 9 used for the purposes designated: 6 10 For deposit in the water quality initiative fund created in 6 11 section 466B.45, for purposes of supporting the water quality 6 12 initiative administered by the division of soil conservation 6 13 and water quality as provided in section 466B.42, including 6 14 salaries, support, maintenance, and miscellaneous purposes: 6 15 .................................................. $1,500,0006 16 3,000,000 6 17 2. a. The moneys appropriated in subsection 1 shall be 6 18 used to support projects in subwatersheds as designated by the 6 19 division that are part of high=priority watersheds identified 6 20 by the water resources coordinating council established 6 21 pursuant to section 466B.3. 6 22 b. The moneys appropriated in subsection 1 shall be used to 6 23 support projects in watersheds generally, including regional 6 24 watersheds, as designated by the division and high=priority 6 25 watersheds identified by the water resources coordinating 6 26 council established pursuant to section 466B.3. 6 27 3. In supporting projects in subwatersheds and watersheds 6 28 as provided in subsection 2, all of the following shall apply: 6 29 a. The demonstration projects shall utilize water quality 6 30 practices as described in thelatest revision of the document 6 31 entitled "Iowa Nutrient Reduction Strategy" initially presented 6 32 in November 2012 by the department of agriculture and land 6 33 stewardship, the department of natural resources, and Iowa 6 34 state university of science and technologyIowa nutrient 6 35 reduction strategy as defined in section 455B.171, as amended 7 1 by 2018 Iowa Acts, Senate File 512, section 18. 7 2 b. The division shall implement demonstration projects as 7 3 provided in paragraph "a" by providing for participation by 7 4 persons who hold a legal interest in agricultural land used in 7 5 farming. To every extent practical, the division shall provide 7 6 for collaborative participation by such persons who hold a 7 7 legal interest in agricultural land located within the same 7 8 subwatershed. 7 9 c. The division shall implement a demonstration project on 7 10 a cost=share basis as determined by the division. However, 7 11 except for edge=of=field practices, the state's share of the 7 12 amount shall not exceed 50 percent of the estimated cost of 7 13 establishing the practice as determined by the division or 7 14 50 percent of the actual cost of establishing the practice, 7 15 whichever is less. 7 16 d. The demonstration projects shall be used to educate other 7 17 persons about the feasibility and value of establishing similar 7 18 water quality practices. The division shall promote field day 7 19 events for purposes of allowing interested persons to establish 7 20 water quality practices on their agricultural land. 7 21 e. The division shall conduct water quality evaluations 7 22 within supported subwatersheds. Within a reasonable period 7 23 after accumulating information from such evaluations, the 7 24 division shall create an aggregated database of water quality 7 25 practices. Any information identifying a person holding a 7 26 legal interest in agricultural land or specific agricultural 7 27 land shall be a confidential record under section 22.7. 7 28 4. The moneys appropriated in subsection 1 shall be used 7 29 to support education and outreach in a manner that encourages 7 30 persons who hold a legal interest in agricultural land used for 7 31 farming to implement water quality practices, including the 7 32 establishment of such practices in watersheds generally, and 7 33 not limited to subwatersheds or high=priority watersheds. 7 34 5. The moneys appropriated in subsection 1 may be used 7 35 to contract with persons to coordinate the implementation of 8 1 efforts provided in this section. 8 2 6. The moneys appropriated in subsection 1 may be used by 8 3 the department to support urban soil and water conservation 8 4 efforts, which may include but are not limited to management 8 5 practices related to bioretention, landscaping, the use of 8 6 permeable or pervious pavement, and soil quality restoration. 8 7 The moneys shall be allocated on a cost=share basis as provided 8 8 in chapter 161A. 8 9 7. Notwithstanding any other provision of law to the 8 10 contrary, the department may use moneys appropriated in 8 11 subsection 1 to carry out the provisions of this section on a 8 12 cost=share basis in combination with other moneys available to 8 13 the department from a state or federal source. 8 14 8. Not more than 10 percent of the moneys appropriated in 8 15 this section may be used to pay for the costs of administering 8 16 and implementing the water quality initiative by the 8 17 department's division of soil conservation and water quality as 8 18 provided in section 466B.42 and this section. 8 19 DIVISION III 8 20 DEPARTMENT OF NATURAL RESOURCES 8 21 GENERAL APPROPRIATIONS 8 22 GENERAL FUND AND MAJOR FUNDS 8 23 Sec. 10. 2017 Iowa Acts, chapter 168, section 44, is amended 8 24 to read as follows: 8 25 SEC. 44. GENERAL FUND ==== DEPARTMENT. 8 26 1. There is appropriated from the general fund of the state 8 27 to the department of natural resources for the fiscal year 8 28 beginning July 1, 2018, and ending June 30, 2019, the following 8 29 amount, or so much thereof as is necessary, to be used for the 8 30 purposes designated: 8 31 For purposes of supporting the department, including its 8 32 divisions, for administration, regulation, and programs; for 8 33 salaries, support, maintenance, and miscellaneous purposes; and 8 34 for not more than the following full=time equivalent positions: 8 35 .................................................. $5,649,905.509 1 11,584,987 9 2 ............................................... Of the number of full=time equivalent positions 9 4 authorized to the department pursuant to subsection 1, 50 9 5 full=time equivalent positions shall be allocated by the 9 6 department for seasonal employees for purposes of providing 9 7 maintenance, upkeep, and sanitary services at state parks. 9 8 This subsection shall not impact park ranger or park manager 9 9 positions within the department. 9 10 3. The department shall submit a report each quarter of the 9 11 fiscal year to the legislative services agency, the department 9 12 of management, the members of the joint appropriations 9 13 subcommittee on agriculture and natural resources, and the 9 14 chairpersons and ranking members of the senate and house 9 15 committees on appropriations. The report shall describe in 9 16 detail the expenditure of moneys appropriated under this 9 17 section to support the department's administration, regulation, 9 18 and programs. 9 19 Sec. 11. 2017 Iowa Acts, chapter 168, section 45, is amended 9 20 to read as follows: 9 21 SEC. 45. STATE FISH AND GAME PROTECTION FUND ==== REGULATION 9 22 AND ADVANCEMENT OF OUTDOOR ACTIVITIES. 9 23 1. There is appropriated from the state fish and game 9 24 protection fund created pursuant to section 456A.17 to the 9 25 department of natural resources for the fiscal year beginning 9 26 July 1, 2018, and ending June 30, 2019, the following amount, 9 27 or so much thereof as is necessary, to be used for the purposes 9 28 designated: 9 29 For purposes of supporting the regulation or advancement of 9 30 hunting, fishing, or trapping, or the protection, propagation, 9 31 restoration, management, or harvest of fish or wildlife, 9 32 including for administration, regulation, law enforcement, and 9 33 programs; and for salaries, support, maintenance, equipment, 9 34 and miscellaneous purposes: 9 35 .................................................. $21,573,996.5010 1 43,768,530 10 2 2. Notwithstanding section 455A.10, the department may use 10 3 the unappropriated balance remaining in the state fish and game 10 4 protection fund to provide for the funding of health and life 10 5 insurance premium payments from unused sick leave balances of 10 6 conservation peace officers employed in a protection occupation 10 7 who retire, pursuant to section 97B.49B. 10 8 3. Notwithstanding section 455A.10, the department of 10 9 natural resources may use the unappropriated balance remaining 10 10 in the state fish and game protection fund for the fiscal 10 11 year beginning July 1, 2018, and ending June 30, 2019, as is 10 12 necessary to fund salary adjustments for departmental employees 10 13 for which the general assembly has made an operating budget 10 14 appropriation in subsection 1. 10 15 Sec. 12. 2017 Iowa Acts, chapter 168, section 46, is amended 10 16 to read as follows: 10 17 SEC. 46. GROUNDWATER PROTECTION FUND ==== WATER 10 18 QUALITY. In supporting projects in subwatersheds and watersheds 20 32 as provided in subsection 2, all of the following shall apply: 20 33 a. The demonstration projects shall utilize water quality 20 34 practices as described in thelatest revision of the document 20 35 entitled "Iowa Nutrient Reduction Strategy" initially presented 21 1 in November 2012 by the department of agriculture and land 21 2 stewardship, the department of natural resources, and Iowa 21 3 state university of science and technologyIowa nutrient 21 4 reduction strategy as defined in section 455B.171, as amended 21 5 by 2018 Iowa Acts, Senate File 512, section 18. 21 6 b. The division shall implement demonstration projects as 21 7 provided in paragraph "a" by providing for participation by 21 8 persons who hold a legal interest in agricultural land used in 21 9 farming. To every extent practical, the division shall provide 21 10 for collaborative participation by such persons who hold a 21 11 legal interest in agricultural land located within the same 21 12 subwatershed. 21 13 c. The division shall implement a demonstration project on 21 14 a cost=share basis as determined by the division. However, 21 15 except for edge=of=field practices, the state's share of the 21 16 amount shall not exceed 50 percent of the estimated cost of 21 17 establishing the practice as determined by the division or 21 18 50 percent of the actual cost of establishing the practice, 21 19 whichever is less. 21 20 d. The demonstration projects shall be used to educate other 21 21 persons about the feasibility and value of establishing similar 21 22 water quality practices. The division shall promote field day 21 23 events for purposes of allowing interested persons to establish 21 24 water quality practices on their agricultural land. 21 25 e. The division shall conduct water quality evaluations 21 26 within supported subwatersheds. Within a reasonable period 21 27 after accumulating information from such evaluations, the 21 28 division shall create an aggregated database of water quality 21 29 practices. Any information identifying a person holding a 21 30 legal interest in agricultural land or specific agricultural 21 31 land shall be a confidential record under section 22.7. 21 32 4. The moneys appropriated in subsection 1 shall be used 21 33 to support education and outreach in a manner that encourages 21 34 persons who hold a legal interest in agricultural land used for 21 35 farming to implement water quality practices, including the 22 1 establishment of such practices in watersheds generally, and 22 2 not limited to subwatersheds or high=priority watersheds. 22 3 5. The moneys appropriated in subsection 1 may be used 22 4 to contract with persons to coordinate the implementation of 22 5 efforts provided in this section. 22 6 6. The moneys appropriated in subsection 1 may be used by 22 7 the department to support urban soil and water conservation 22 8 efforts, which may include but are not limited to management 22 9 practices related to bioretention, landscaping, the use of 22 10 permeable or pervious pavement, and soil quality restoration. 22 11 The moneys shall be allocated on a cost=share basis as provided 22 12 in chapter 161A. 22 13 7. Notwithstanding any other provision of law to the 22 14 contrary, the department may use moneys appropriated in 22 15 subsection 1 to carry out the provisions of this section on a 22 16 cost=share basis in combination with other moneys available to 22 17 the department from a state or federal source. 22 18 8. Not more than 10 percent of the moneys appropriated in 22 19 this section may be used to pay for the costs of administering 22 20 and implementing the water quality initiative by the 22 21 department's division of soil conservation and water quality as 22 22 provided in section 466B.42 and this section. 22 23 DIVISION VII 22 24 IOWA RESOURCES ENHANCEMENT AND PROTECTION (REAP) FUND 22 25 SPECIAL PROVISIONS 22 26 Sec. 22. 2017 Iowa Acts, chapter 168, is amended by adding 22 27 the following new section: 22 28 NEW SECTION. SEC. 58. REAP ==== OPEN SPACES ACCOUNT ==== 23 22 STATE PARK MAINTENANCE AND REPAIR. Notwithstanding section 23 23 455A.19, subsection 1, paragraph "a", subparagraph (1), of 23 24 the moneys allocated to the open spaces account of the Iowa 23 25 resources enhancement and protection fund, up to $1,000,000 may 23 26 be used by the department of natural resources for state park 23 27 maintenance and repair for the fiscal year beginning July 1, 23 28 2018, and ending on June 30, 2019. 23 29 DIVISION VIII 23 30 IOWA CODE CHANGES 23 31 Sec. 25. NEW SECTION. 455B.262B Cooperation with the state 23 32 geologist. 23 33 The department may request and receive assistance from the 23 34 state geologist pursuant to section 456.14 to allow for the 23 35 allocation and use of water resources, and the preclusion of 24 1 conflicts among users of water resources, as provided in this 24 2 part. 24 3 Sec. 26. NEW SECTION. 456.14 Water resource management. 24 4 1. The state geologist shall maintain historical data, 24 5 collect existing data, and compile new data regarding water 24 6 resources, including surface water sources and groundwater 24 7 sources, and geological formations that impact upon those water 24 8 resources. Such data shall be managed in a manner that allows 24 9 it to be made available for use by the department of natural 24 10 resources and the public. 24 11 2. The state geologist shall measure, assess, and evaluate 24 12 groundwater sources and subsurface geological formations in 24 13 a manner that assists the department of natural resources in 24 14 optimizing allocations and uses of groundwater sources in 24 15 this state, including as provided in chapter 455B, division 24 16 III, part 4. The state geologist may use data described in 24 17 subsection 1 to measure, assess, and evaluate all of the 24 18 following: 24 19 a. The sustainability and existing or potential 24 20 vulnerabilities of groundwater sources. 24 21 b. The risk, prediction, or indication of drought, the 24 22 impacts of drought, and the presence, intensity, or duration 24 23 of drought conditions. 24 24 c. Subsurface geologic hazards to groundwater resources. 24 25 d. The recharge of groundwater sources, including recharge 24 26 rates. 24 27 e. The presence of reserves of groundwater sources. 24 28 f. The potential of groundwater sources present in 24 29 subsurface geologic formations. 24 30 3. The state geologist shall develop and use management 24 31 tools, computer programming, or modeling as necessary or 24 32 convenient to administer this section. 24 33 4. The state geologist shall prepare, use, and make 24 34 available maps or other methods of presentation that provide 24 35 for the geospatial visualization of data described in 25 1 subsection 1 as necessary or convenient to administer this 25 2 section. 25 3 5. Upon request by the department of natural resources, the 25 4 state geologist shall assist the department in regulating water 25 5 quantity from water resources as provided in section 455B.262B. 25 6 EXPLANATION 25 7 The inclusion of this explanation does not constitute agreement with 25 8 the explanation's substance by the members of the general assembly. 25 9 GENERAL. This bill relates to agriculture and natural 25 10 resources by making appropriations for the fiscal year 25 11 beginning July 1, 2018, and ending June 30, 2019, to support 25 12 related entities, including the department of agriculture and 25 13 land stewardship (DALS), the department of natural resources 25 14 (DNR), Iowa state university of science and technology (ISU), 25 15 and the state university of Iowa (UI). 25 16 The bill primarily appropriates moneys to DALS and DNR. 25 17 The appropriations are made to support those departments 25 18 for administration, regulation, and enforcement of certain 25 19 programs. The bill requires the departments to submit 25 20 quarterly reports to the general assembly and department of 25 21 management regarding the expenditure of appropriated moneys. 25 22 The bill also provides moneys to support specific programs 25 23 or projects administered by those departments. The bill 25 24 appropriates moneys from a number of sources, including the 25 25 general fund of the state (general fund), including a number 25 26 of major funds, including the state fish and game protection 25 27 fund (Code section 456A.17), the groundwater protection fund 25 28 (Code section 455E.11), and the environment first fund (EFF) 25 29 (Code section 8.57A). The bill also appropriates moneys from 25 30 a number of other sources, including unclaimed pari=mutuel 25 31 wagering winnings (Code section 99D.13), the renewable fuel 25 32 infrastructure fund (Code section 159A.16), the special 25 33 snowmobile fund (Code section 321G.7), and the unassigned 25 34 revenue fund (uncodified). The bill is organized into 25 35 divisions. 26 1 DALS ==== GENERAL FUND APPROPRIATION. For DALS, the bill 26 2 appropriates moneys from the general fund in order to support 26 3 its administrative divisions, including consumer protection 26 4 and industry services, soil conservation, and food safety and 26 5 animal health. Moneys are transferred to ISU to support its 26 6 midwest grape and wine institute. 26 7 DALS ==== MISCELLANEOUS SOURCES ==== DESIGNATED APPROPRIATIONS. 26 8 The bill appropriates moneys to DALS from several sources in 26 9 order to support a number of designated purposes, including 26 10 moneys derived from unclaimed winnings from horse and 26 11 dog races, for administration and enforcement of racing 26 12 regulations; and moneys credited to the renewable fuel 26 13 infrastructure fund for purposes of motor fuel inspection and 26 14 auditing biofuel processing and production. 26 15 DALS ==== SPECIAL GENERAL FUND APPROPRIATIONS. The bill 26 16 makes special appropriations from the general fund to DALS in 26 17 order to support specific purposes including milk inspection, 26 18 the local food and farm program, an agricultural education 26 19 organization, and assistance to farmers with disabilities. The 26 20 bill also appropriates moneys to DALS for deposit in the animal 26 21 disease preparedness and response fund (Code section 163.3B). 26 22 DALS ==== GENERAL FUND APPROPRIATIONS ==== WATER QUALITY 26 23 INITIATIVE (WQI). The bill appropriates moneys from the 26 24 general fund to DALS for deposit in the water quality 26 25 initiative fund (Code section 466B.45) to support the WQI, 26 26 including high=priority watershed projects. 26 27 DNR ==== GENERAL FUND AND OTHER MAJOR FUNDS APPROPRIATIONS. 26 28 The bill makes appropriations from the general fund and several 26 29 major funds to DNR in order to support its administrative 26 30 divisions involving natural resources and environmental 26 31 protection including moneys credited to the state fish and 26 32 game protection fund and moneys credited to the groundwater 26 33 protection fund that are not otherwise statutorily allocated. 26 34 DNR ==== MISCELLANEOUS SOURCES ==== DESIGNATED APPROPRIATIONS. 26 35 The bill appropriates moneys to DNR from a number of sources 27 1 to support designated purposes, including moneys deposited in 27 2 the special snowmobile fund to provide for administering and 27 3 enforcing the state snowmobile programs; and moneys deposited 27 4 in the unassigned revenue fund for purposes of paying for 27 5 administration of DNR's underground storage tanks section. 27 6 DNR ==== SPECIAL GENERAL FUND APPROPRIATIONS. The bill also 27 7 makes special appropriations from the general fund to DNR 27 8 in order to support specific purposes including floodplain 27 9 management and dam safety and forestry health management 27 10 programs. 27 11 ISU ==== SPECIAL GENERAL FUND APPROPRIATION. The bill 27 12 appropriates moneys from the general fund to ISU to support the 27 13 operation of the veterinary diagnostic laboratory operated by 27 14 the college of veterinary medicine. 27 15 DALS, DNR, AND UI ==== EFF GENERAL APPROPRIATIONS. The 27 16 bill appropriates moneys from the EFF to support a number 27 17 of programs administered by DALS and DNR. For DALS, the 27 18 moneys are appropriated to support programs involving soil 27 19 conservation, watershed protection and nutrient management, 27 20 and the loess hills development and conservation fund. For 27 21 DNR, moneys are appropriated to support programs involving 27 22 state parks, geographic information systems, water quality 27 23 monitoring, public water supplies, regulation of animal feeding 27 24 operations, air quality, and floodplain management and dam 27 25 safety. 27 26 UI ==== WATER QUANTITY MANAGEMENT. The bill appropriates 27 27 moneys from EFF to UI to support the geological and water 27 28 survey for its operations and to measure, assess, and evaluate 27 29 water quantity sources and assist DNR in regulating water 27 30 quantity. 27 31 DALS ==== EFF SPECIAL WQI APPROPRIATION. The bill 27 32 appropriates additional moneys from the EFF to the water 27 33 quality initiative fund to support the WQI administered by 27 34 DALS, subject to the same conditions applicable to moneys 27 35 appropriated to that fund from the general fund. 28 1 IOWA RESOURCES ENHANCEMENT AND PROTECTION (REAP) FUND ==== 28 2 SPECIAL PROVISIONS. The bill appropriates moneys from the EFF 28 3 to the REAP fund in lieu of the $20 million standing limited 28 4 appropriation from the general fund (Code section 455A.18). 28 5 The bill appropriates moneys from the REAP fund to DNR to 28 6 support the regular maintenance and operations of state parks 28 7 and staff prior to allocations made from the fund. DNR is also 28 8 authorized to use moneys allocated to the fund's open spaces 28 9 account for state park maintenance and repair. 28 10 CODIFIED STATUTORY PROVISIONS. The bill provides that DNR 28 11 request cooperation with the state geologist and requires 28 12 the state geologist to maintain, collect, and compile data 28 13 regarding water resources, including surface water sources and 28 14 groundwater sources, and geological formations that impact upon 28 15 those water resources. The state geologist is also required 28 16 to measure, assess, and evaluate groundwater sources and 28 17 subsurface geological formations in a manner that assists DNR 28 18 in optimizing allocations and uses of groundwater sources in 28 19 this state.
