House File 293 - Introduced HOUSE FILE BY COMMITTEE ON STATE GOVERNMENT (SUCCESSOR TO HSB 49) A BILL FOR 1 An Act concerning state purchasing from prison industries for 2 products manufactured in this state. 3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: TLSB 1854HV (1) 87 ec/nh PAG LIN 1 1 Section 1. Section 8A.311, Code 2017, is amended by adding 1 2 the following new subsection: 1 3 NEW SUBSECTION. 12A. The director shall adopt rules which 1 4 provide that a department or agency is not required to comply 1 5 with the requirements of section 904.808 for the purchase of 1 6 a product if the department or agency can verify that the 1 7 product is manufactured within the state. However, the rules 1 8 shall provide that if a department or agency is not required 1 9 to comply with the requirements of section 904.808, Iowa state 1 10 industries, as defined in section 904.802, shall be allowed to 1 11 submit a bid to provide the product to be purchased. 1 12 EXPLANATION 1 13 The inclusion of this explanation does not constitute agreement with 1 14 the explanation's substance by the members of the general assembly. 1 15 Code section 8A.311, concerning competitive bidding 1 16 procedures, is amended to provide that the director of the 1 17 department of administrative services (DAS) shall adopt rules 1 18 providing that DAS or any other state agency shall not be 1 19 required to comply with the requirements relating to purchasing 1 20 from prison industries if the product to be purchased is 1 21 manufactured in this state. The bill further provides that the 1 22 rules shall also provide that if DAS or any other state agency 1 23 is not required to comply, prison industries shall be allowed 1 24 to submit a bid to provide the product.
