NEW SECTION. 161D.9 Restriction. 1 2 The loess hills development and conservation authority 1 3 or the board of directors of the loess hills alliance shall 1 4 not enter into any agreement with a local government or the 1 5 state or federal government if the agreement regulates, on an 1 6 involuntary basis, the action of a private landowner or the use 1 7 of a private landowner's land. 1 8 EXPLANATION 1 9 The inclusion of this explanation does not constitute agreement with 1 10 the explanation's substance by the members of the general assembly. 1 11 BILL. This bill prohibits the loess hills development 1 12 and conservation authority or the board of directors of the 1 13 loess hills alliance from entering into any agreement with a 1 14 local government, or the state or federal government, if such 1 15 agreement would regulate a person who is a private landowner 1 16 or the person's use of that land. The bill does not apply to 1 17 actions in which the private landowner consents. 1 18 BACKGROUND. The loess hills development and conservation 1 19 authority includes Adair, Adams, Audubon, Carroll, Cass, 1 20 Cherokee, Crawford, Fremont, Guthrie, Harrison, Ida, Lyon, 1 21 Mills, Monona, Montgomery, Page, Plymouth, Pottawattamie, Sac, 1 22 Shelby, Sioux, Taylor, and Woodbury counties (Code section 1 23 161D.1(1)). The mission of the authority is to develop and 1 24 coordinate plans for projects related to the unique natural 1 25 resource, rural development, and infrastructure problems 1 26 of counties in the deep loess region of western Iowa (Code 1 27 section 161D.1(2)). The loess hills alliance includes Fremont, 1 28 Harrison, Mills, Monona, Plymouth, Pottawattamie, and Woodbury 1 29 counties. The alliance is governed by a board of directors 1 30 (Code section 161D.5(1)). The mission of the alliance is to 1 31 create a common vision for Iowa's loess hills, protecting 1 32 special natural and cultural resources while ensuring economic 1 33 viability and private property rights of the region (Code 1 34 section 161D.4).
