Section
1.
Section
331.756,
Code
2025,
is
amended
by
adding
1
the
following
new
subsection:
2
NEW
SUBSECTION
.
76.
a.
In
the
case
of
an
officer-involved
3
shooting
resulting
in
the
death
or
serious
bodily
injury
of
a
4
person,
review
the
evidence
and
render
a
written
opinion
and
5
charging
decision,
convene
a
grand
jury,
or
refer
the
case
to
6
the
attorney
general
as
provided
in
section
13.12.
7
b.
A
written
report
detailing
the
results
of
the
review
8
specified
in
paragraph
“a”
shall
be
provided
to
the
officer
9
involved
or
the
officer’s
legal
counsel
and
the
officer’s
10
employing
agency
within
one
hundred
eighty
days
of
the
county
11
attorney’s
receipt
of
evidence.

c.
If
the
case
presents
a
conflict
of
interest,
the
review
13
shall
be
referred
to
an
independent
county
attorney,
the
14
attorney
general,
or
a
special
prosecutor.

d.
For
the
purposes
of
this
subsection,
“officer”
means
the
16
same
as
defined
in
section
801.4,
subsection
11.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
19
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
relates
to
the
review
of
an
officer-involved
21
shooting
case
by
a
county
attorney.
22
The
bill
provides
that
in
the
case
of
an
officer-involved
23
shooting
resulting
in
the
death
or
serious
bodily
injury
of
24
a
person,
the
county
attorney
shall
review
the
evidence
and
25
render
a
written
opinion
and
charging
decision,
convene
a
26
grand
jury,
or
refer
the
case
to
the
attorney
general.
A
27
written
report
detailing
the
results
of
the
review
shall
be
28
provided
to
the
officer
involved
or
the
officer’s
legal
counsel
29
and
the
officer’s
employing
agency
within
180
days
of
the
30
county
attorney’s
receipt
of
evidence.
If
the
case
presents
31
a
conflict
of
interest,
the
review
shall
be
referred
to
an
32
independent
county
attorney,
the
attorney
general,
or
a
special

prosecutor.
