Section
462A.15,
subsection
2,
Code
2021,
is

amended
to
read
as
follows:

section
does
not
apply
to
a
performer
engaged
in

a
professional
exhibition
,
or
a
person
or
persons
engaged
in

a
professional
exhibition
,
or
a
person
or
persons
engaged
in
5
an
activity
authorized
under
section
462A.16
,
or
a
person
6
operating
a
vessel
equipped
with
a
mirror,
so
located
as
to
7
reflect
to
the
operator
a
view
of
the
person
or
persons
being
8
towed,
or
other
equipment
that
allows
the
operator
to
observe
9
the
towed
person
or
persons
while
operating
the
vessel
.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
12
the
explanation’s
substance
by
the
members
of
the
general
assembly.

Current
law
prohibits
a
water
vessel
towing
a
person
from
14
being
operated
on
waters
under
the
jurisdiction
of
the
natural
15
resource
commission
unless
a
responsible
person,
in
addition
16
to
the
operator,
is
in
a
position
to
observe
the
progress
17
of
the
person
being
towed.
This
prohibition
does
not
apply
18
to
performers
engaged
in
a
professional
exhibition,
persons
19
engaged
in
a
professional
exhibition,
or
persons
engaged
in
20
regattas,
races,
marine
parades,
tournaments,
or
exhibitions.

This
bill
allows
a
person
to
operate
a
vessel
while
towing
a
22
person
without
an
observer
if
the
person
operating
the
vessel
23
is
able
to
observe
the
towed
person
while
operating
the
vessel
24
by
use
of
a
mirror
or
other
equipment.
25
A
violation
of
Code
section
462A.15
is
punishable
by
a
26
scheduled
fine
of
$35.
