Section
1.
STUDY
AND
REPORT
OF
MEDICAID
INSTITUTIONS
FOR
1
MENTAL
DISEASES
WAIVER
AND
THE
AVAILABILITY
OF
MENTAL
HEALTH

SERVICES.
The
department
of
human
services
shall
conduct
a
3
statewide
study
of
the
current
availability
of
mental
health
4
services
in
the
state.
The
study
will
research
and
evaluate
5
the
current
availability
of
mental
health
services
across
the
6
continuum
of
care
and
the
potential
value
of
pursuing
a
section
7
1115
demonstration
waiver
as
specified
in
section
12003
of
the
8
federal
21st
Century
Cures
Act,
Pub.
L.
No.
114-255,
to
provide
9
for
reimbursement
for
services
provided
in
settings
that
10
qualify
as
institutions
for
mental
diseases.
The
department
11
shall
submit
a
final
report
of
the
results
of
the
study
to
the
12
governor
and
the
general
assembly
by
February
15,
2022.

Sec.
2.
EFFECTIVE
DATE.
This
Act,
being
deemed
of
immediate
14
importance,
takes
effect
upon
enactment.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
17
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
requires
the
department
of
human
services
(DHS)
to
19
conduct
a
statewide
study
of
the
current
availability
of
mental
20
health
services
in
the
state,
including
the
potential
value
21
of
pursuing
a
section
1115
demonstration
waiver
as
specified
22
under
the
federal
21st
Century
Cures
Act,
to
provide
for
23
reimbursement
for
services
provided
in
settings
that
qualify
24
as
institutions
for
mental
diseases.
DHS
shall
submit
a
final
25
report
of
the
results
of
the
study
to
the
governor
and
to
the
26
general
assembly
by
February
15,
2022.
The
bill
takes
effect
27
upon
enactment.
