amended
to
read
as
follows:

Two
percent
is
appropriated
annually
to
the
department
and,

except
for
administrative
expenses,
is
transferred
to
the
Iowa
5
department
of
public
health
for
the
purpose
of
administering
6
grants
to
counties
and
conducting
oversight
of
county-based
7
programs
for
the
testing
of
private
rural
water
supply
wells,
8
private
rural
water
supply
well
sealing,
and
the
proper
closure
9
of
private
rural
abandoned
wells
and
cisterns
,
and
testing
10
water
supply
systems,
as
defined
in
section
455B.211,
for
11
the
existence
of
lead
and
copper
.
Not
more
than
thirty-five
12
percent
of
the
moneys
is
appropriated
annually
for
grants
to
13
counties
for
the
purpose
of
conducting
programs
of
private
14
rural
water
supply
testing,
private
rural
water
supply
well
15
sealing,
the
proper
closure
of
private
rural
abandoned
wells
16
and
cisterns,
water
supply
system
testing
for
the
existence
17
of
lead
and
copper,
or
any
combination
thereof.
An
amount
18
agreed
to
by
the
department
of
natural
resources
and
the
Iowa
19
department
of
public
health
shall
be
retained
by
the
department
20
of
natural
resources
for
administrative
expenses.

Sec.
2.
Section
455E.11,
subsection
2,
paragraph
b,
22
subparagraph
(2),
subparagraph
division
(b),
subparagraph
23
subdivision
(i),
Code
2021,
is
amended
to
read
as
follows:

(i)
A
county
applying
for
grants
under
this
subparagraph
25
division
shall
submit
only
one
application.
To
be
eligible
for
26
a
grant,
a
county
must
have
adopted
standards
for
private
water
27
supply
and
private
disposal
facilities
at
least
as
stringent
as
28
the
standards
adopted
by
the
commission.
During
each
fiscal
29
year,
the
amount
granted
each
eligible
applicant
shall
be
30
the
total
funds
available
divided
by
the
number
of
eligible
31
counties
applying.
Upon
receipt
of
the
grant,
the
county
may
32
apply
the
funds
to
any
one
or
more
of
the
county-based
programs
33
for
the
testing
of
private
rural
water
supply
wells,
private
34
rural
water
supply
well
sealing,
and
the
proper
closure
of

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
4
the
explanation’s
substance
by
the
members
of
the
general
assembly.

Under
current
law,
moneys
in
the
groundwater
protection
fund
6
are
used
for
purposes
related
to
groundwater
monitoring
and
7
groundwater
quality
standards.
The
agricultural
management
8
account
consists
of
moneys
deposited
in
the
account
from
the
9
collection
of
fertilizer
inspection
fees,
pesticide
dealer
10
license
fees,
pesticide
registration
fees,
and
other
moneys
11
designated
for
the
purpose
of
agricultural
management.
After
12
an
appropriation
of
$9,000
to
the
Iowa
department
of
public
13
health,
2
percent
of
the
remaining
moneys
is
appropriated
14
to
the
department
of
natural
resources
(DNR)
and,
excluding
15
administrative
expenses
for
the
DNR,
transferred
to
the
16
Iowa
department
of
public
health
(DPH)
for
the
purpose
of
17
administering
grants
to
counties
and
conducting
oversight
of
18
county-based
programs
related
to
private
well
testing,
sealing,
19
and
closure.

This
bill
allows
DPH
to
use
moneys
appropriated
to
the
21
grants
to
counties
program
for
testing
water
supply
systems
for
22
the
existence
of
lead
and
copper.
For
purposes
of
the
bill,
23
“water
supply
system”
means
the
system
of
pipes,
structures,
24
and
facilities
through
which
a
public
water
supply
is
obtained,
25
treated,
and
sold
or
distributed
for
human
consumption
or
26
household
use.
