S.F. 2128 Section 1. Section 321I.1, subsection 17, paragraph a, Code 1 2014, is amended to read as follows: 2 a. “Off-road utility vehicle” means a motorized vehicle with 3 not less than four and not more than eight nonhighway tires or 4 rubberized tracks that is limited in engine displacement to 5 less than one thousand five hundred cubic centimeters and in 6 total dry weight to not more than two thousand pounds and that 7 has a seat that is of bucket or bench design, not intended to 8 be straddled by the operator, and a steering wheel or control 9 levers for control. “Off-road utility vehicle” includes the 10 following vehicles: 11 (1) “Off-road utility vehicle —— type 1” means an off-road 12 utility vehicle with a total dry weight of one thousand two 13 hundred pounds or less and a width of fifty inches or less. 14 (2) “Off-road utility vehicle —— type 2” means an off-road 15 utility vehicle, other than a type 1 off-road utility vehicle, 16 with a total dry weight of two thousand pounds or less, and a 17 width of sixty-five inches or less. 18 (3) Off-road utility vehicle —— type 3” means an off-road 19 utility vehicle with a total dry weight of more than two 20 thousand pounds or a width of more than sixty-five inches, or 21 both. 22 EXPLANATION 23 The inclusion of this explanation does not constitute agreement with 24 the explanation’s substance by the members of the general assembly. 25 This bill revises the definition of “off-road utility 26 vehicle” in Code chapter 321I, which provides for the 27 registration and regulation of all-terrain and off-road utility 28 vehicles by the department of natural resources and authorizes 29 and limits the use of those vehicles on designated riding 30 areas and trails. “Off-road utility vehicle” is defined as a 31 motorized vehicle with not less than four and not more than 32 eight nonhighway tires or rubberized tracks, a bucket or bench 33 seat, and a steering wheel or control levers.
