1.
NEW
SECTION
.
279.72
Health
screenings
——
1
prohibition.

1.
Each
school
district
is
prohibited
from
administering
3
or
conducting
a
student
health
screening
that
is
not
required
4
by
state
or
federal
law
without
first
acquiring
the
written
5
consent
of
the
student’s
parent
or
guardian.
This
section
6
applies
only
to
a
minor
child
in
the
direct
care
of
a
parent
or
7
guardian,
and
does
not
apply
to
an
emancipated
minor
or
a
minor
8
who
is
not
residing
with
the
parent
or
guardian.

2.
This
section
shall
not
be
construed
to
prohibit
a
school
10
district
from
conducting
health
screenings
in
emergent
care
11
situations
or
from
cooperating
in
a
child
abuse
assessment
12
commenced
in
accordance
with
section
232.71B.

3.
For
purposes
of
this
section,
“student
health
screening”
14
means
an
intentionally
planned,
periodic
process
to
identify
if
15
a
student
may
be
at
risk
for
a
health
concern
and
to
determine
16
if
a
referral
for
an
in-depth
assessment
is
needed
to
consider
17
appropriate
health
services.

EXPLANATION
19
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
20
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
prohibits
school
districts
from
administering
or
22
conducting
student
health
screenings
that
are
not
required
23
by
state
or
federal
law
unless
the
school
district
has
first
24
acquired
the
written
consent
of
the
students’
parent
or
25
guardian.

However,
the
prohibition
applies
only
to
a
minor
child
in
27
the
direct
care
of
a
parent
or
guardian,
and
does
not
apply
to
28
an
emancipated
minor
or
a
minor
who
is
not
residing
with
the
29
parent
or
guardian.
In
addition,
the
provision
shall
not
be
30
construed
to
prohibit
a
school
district
from
conducting
health
31
screenings
in
emergent
care
situations
or
from
cooperating
in
a

abuse
assessment.
