Section 321G.13, subsection 2, paragraph b, Code 1 2 2018, is amended to read as follows: 1 3 b. (1) A person may operate or ride a snowmobile with a 1 4 loaded firearm, whether concealed or not, without a permit to 1 5 carry weapons, if the person operates or rides on land owned, 1 6orpossessed, or rented by the person,and the person's conduct 1 7 is otherwise lawful. 1 8 (2)IfA person may operate or ride on a snowmobile with 1 9 a loaded pistol or revolver, whether concealed or not, if a 1 10 person is operating or ridingathe snowmobile on land that is 1 11 not owned,orpossessed, or rented by the person,the person 1 12 may operate or ride the snowmobile with a loaded pistol or 1 13 revolver, whether concealed or not,and the person's conduct is 1 14 otherwise lawful. 1 15 Sec. 2. Section 321G.13, Code 2018, is amended by adding the 1 16 following new subsection: 1 17 NEW SUBSECTION. 4. As used in this section, "rented by the 1 18 person" includes a person who does not necessarily rent the 1 19 land but who principally provides labor for the production of 1 20 crops located on agricultural land or for the production of 1 21 livestock principally located on agricultural land. The person 1 22 must personally provide such labor on a regular, continuous, 1 23 and substantial basis. 1 24 Sec. 3. Section 321I.14, subsection 2, paragraph b, Code 1 25 2018, is amended to read as follows: 1 26 b. (1) A person may operate or ride an all=terrain vehicle 1 27 with a loaded firearm, whether concealed or not, without a 1 28 permit to carry weapons, if the person operates or rides on 1 29 land owned,orpossessed, or rented by the person,and the 1 30 person's conduct is otherwise lawful. 1 31 (2)IfA person may operate or ride on all all=terrain 1 32 vehicle with a loaded pistol or revolver, whether concealed 1 33 or not, if a person is operating or ridinganthe all=terrain 1 34 vehicle on land that is not owned,orpossessed, or rented by 1 35 the person,the person may operate or ride the all=terrain 2 1 vehicle with a loaded pistol or revolver, whether concealed or 2 2 not,and the person's conduct is otherwise lawful. 2 3 Sec. 4. Section 321I.14, Code 2018, is amended by adding the 2 4 following new subsection: 2 5 NEW SUBSECTION. 6. Section 724.4, subsection 4, paragraph a, Code 2018, 2 13 is amended to read as follows: 2 14 a. A person who goes armed with a dangerous weapon in the 2 15 person's own dwelling or place of business, or on land owned, 2 16orpossessed, or rented by the person. 2 17 EXPLANATION 2 18 The inclusion of this explanation does not constitute agreement with 2 19 the explanation's substance by the members of the general assembly. 2 20 This bill relates to carrying weapons and operating or 2 21 riding a snowmobile or all=terrain vehicle while carrying a 2 22 loaded firearm. 2 23 Currently, a person may operate or ride on a snowmobile or 2 24 all=terrain vehicle with a loaded firearm, whether concealed or 2 25 not, without a permit to carry weapons, if the person operates 2 26 or rides on land owned by the person, and the person's conduct 2 27 is otherwise lawful. 2 28 The bill allows a person to operate or ride on a snowmobile 2 29 or all=terrain vehicle with a loaded firearm, whether concealed 2 30 or not, without a permit to carry weapons, if the person 2 31 operates or rides on the snowmobile or all=terrain vehicle 2 32 on land rented by the person, and the person's conduct is 2 33 otherwise lawful. The bill specifies that "rented by the 2 34 person" includes a person who does not necessarily rent the 2 35 land but who principally provides labor for the production of 3 1 crops located on agricultural land or for the production of 3 2 livestock principally located on agricultural land. The person 3 3 must personally provide such labor on a regular, continuous, 3 4 and substantial basis. 3 5 A person who violates Code section 321G.13 (snowmobiles) or 3 6 321I.14 (all=terrain vehicles) commits a simple misdemeanor 3 7 punishable as a scheduled fine of $100 under Code section 3 8 805.8B. 3 9 The bill amends Code section 724.4 relating to carrying 3 10 weapons. Currently, a person does not commit the criminal 3 11 offense of carrying weapons in violation of Code section 3 12 724.4 if the person goes armed with a dangerous weapon in the 3 13 person's own dwelling or place of business, or on land owned or 3 14 possessed by the person, and the person does not qualify for 3 15 another exemption under Code section 724.4(4). Under the bill, 3 16 a person no longer commits the criminal offense of carrying 3 17 weapons in violation of Code section 724.4 if the person goes 3 18 armed with a dangerous weapon on land rented by the person, and 3 19 the person does not qualify for another exemption under Code 3 20 section 724.4.
