  1  1    Section 1.  Section 28E.2, subsection 2, Code 2018, is
  1  2 amended to read as follows:
  1  3    2.  "Public agency" shall mean any political subdivision of
  1  4 this state; any agency of the state government or of the United
  1  5 States; and any political subdivision of another state.  For
  1  6 purposes of this chapter only, "public agency" also includes any
  1  7 federally recognized Indian tribe.
  1  8                           EXPLANATION
  1  9 The inclusion of this explanation does not constitute agreement with
  1 10 the explanation's substance by the members of the general assembly.
  1 11    This bill defines a public agency only for purposes of
  1 12 allowing the joint exercise of governmental powers under Code
  1 13 chapter 28E to include any federally recognized Indian tribe.
