Section 103A.8A, Code 2018, is amended to read 1 2 as follows: 1 3 103A.8A Energy conservation requirements. 1 4 1. a. The state building code commissioner shall adopt 1 5 as a part of the state building code a requirement that 1 6 newsingle=family or two=familyresidential construction 1 7 shall comply with energy conservation requirements. The 1 8 requirements shall be adopted by the commissioner and approved 1 9 by the council no later than July 1, 2018, and shall be 1 10 based upona nationally recognized standard or code for 1 11 energy conservation. The requirements shall only apply to 1 12 single=family or two=family residential construction commenced 1 13 after the adoption of the requirementsthe international 1 14 energy conservation code, 2018 edition. In approving the 1 15 requirements, the council may make modifications to such 1 16 requirements as the council deems necessary by a majority vote 1 17 of the members. 1 18 b. Notwithstanding any other provision of this chapter to 1 19 the contrary, the energy conservation requirements adopted 1 20 by the commissioner and approved by the council pursuant to 1 21 paragraph "a" shall apply to newsingle=family or two=family1 22 residential construction commenced on or after July 1,2008, 1 23 and shall supersede and replace any minimum requirements for 1 24 energy conservation adopted or enacted by a governmental 1 25 subdivision prior to that date applicable to such construction 1 262018. The state building code commissioner may provide 1 27 training to builders, contractors, and other interested persons 1 28 on the adopted energy conservation requirements. 1 29 2. Notwithstanding subsection 1, a governmental subdivision 1 30 may, no later than December 21, 2018, adopt minimum energy 1 31 conservation requirements applicable to residential 1 32 construction described in subsection 1 that are not less 1 33 restrictive than the minimum energy conservation requirements 1 34 adopted by the commissioner and approved by the council. 1 35 If adopted, such requirements shall apply to residential 2 1 construction within the governmental subdivision in lieu of the 2 2 energy conservation requirements adopted by the commissioner 2 3 and approved by the council. 2 4 Sec. 2. Section 103A.10, subsection 5, Code 2018, is amended 2 5 by striking the subsection. 2 6 Sec. 3. EFFECTIVE DATE. This Act, being deemed of immediate 2 7 importance, takes effect upon enactment. 2 8 EXPLANATION 2 9 The inclusion of this explanation does not constitute agreement with 2 10 the explanation's substance by the members of the general assembly. 2 11 This bill relates to energy conservation requirements 2 12 contained within the state building code or adopted by 2 13 governmental subdivisions. 2 14 Code section 103A.8A requires new single=family or 2 15 two=family residential construction commenced on or after 2 16 July 1, 2008, to comply with energy conservation requirements 2 17 adopted by the state building code commissioner and approved 2 18 by the state building code advisory council. The energy 2 19 conservation requirements adopted by the commissioner and 2 20 approved by the council supersede and replace any minimum 2 21 energy conservation requirements adopted by a governmental 2 22 subdivision. 2 23 The bill amends Code section 103A.8A to provide that the 2 24 energy conservation requirements shall be adopted by the 2 25 commissioner and approved by the council no later than July 2 26 1, 2018, and shall be based upon the 2018 edition of the 2 27 international energy conservation code. In approving the 2 28 requirements, the council may make modifications by a majority 2 29 vote of the members. The bill provides that new residential 2 30 construction commenced on or after July 1, 2018, shall comply 2 31 with the energy conservation requirements, extending the 2 32 applicability of such requirements to any type of residential 2 33 building. 2 34 The bill removes language from Code section 103A.8A that 2 35 provides that the energy conservation requirements adopted by 3 1 the commissioner and approved by the council are to supersede 3 2 any minimum requirements adopted by a governmental subdivision. 3 3 The bill makes conforming changes consistent with this 3 4 modification in Code section 103A.10(5). 3 5 The bill provides that a governmental subdivision may, no 3 6 later than December 21, 2018, adopt minimum energy conservation 3 7 requirements for residential construction that are not less 3 8 restrictive than the minimum energy conservation requirements 3 9 adopted by the commissioner and approved by the council. If 3 10 a governmental subdivision adopts such minimum requirements, 3 11 then applicable residential construction must comply with the 3 12 requirements adopted by the governmental subdivision. 3 13 The bill takes effect upon enactment.
