Section
483A.8,
subsection
3,
paragraph
c,
Code

2023,
is
amended
to
read
as
follows:

c.
(1)
(a)
The
commission
shall
annually
limit
to
six
3
thousand
the
number
of
nonresidents
allowed
to
have
antlered
4
or
any
sex
deer
hunting
licenses.
Of
the
six
thousand
5
nonresident
antlered
or
any
sex
deer
hunting
licenses
issued,
6
five
hundred
of
the
licenses
shall
be
reserved
for
nonresidents
7
who
have
made
a
reservation
with
an
outfitter
that
is
currently
8
registered
as
a
business
entity
with
the
secretary
of
state
and
9
has
maintained
registration
since
prior
to
July
1,
2022.
A
10
nonresident
may
only
receive
one
license
under
this
subsection.
11
An
outfitter
shall
certify
to
the
department
that
the
outfitter
12
is
properly
registered
as
a
business
entity.
If
fewer
than
13
five
hundred
nonresidents
apply
for
a
reserved
license
by
14
the
application
deadline
set
by
the
commission
by
rule,
any
15
license
not
issued
shall
be
made
available
for
purchase
at
the
16
same
time
and
in
the
same
manner
as
other
excess
nonresident
17
antlered
or
any
sex
deer
hunting
licenses.
Not
more
than
18
thirty-five
percent
of
the
issued
reserved
licenses
shall
be
19
bow
season
licenses.
The
nonresident
shall
provide
with
the
20
license
application
evidence
that
the
reservation
is
scheduled
21
during
a
period
in
which
the
license
is
valid.
Of
the
six
22
thousand
remaining
nonresident
antlered
or
any
sex
deer
hunting
23
licenses
issued,
not
more
than
thirty-five
percent
of
the
24
licenses
shall
be
bow
season
licenses.
25
(b)
For
purposes
of
this
subparagraph,
“outfitter”
means
a
26
business
that
offers
any
of
the
following
services
in
relation
27
to
hunting:
28
(i)
Transportation
services
for
individuals,
equipment,
29
supplies,
or
wildlife
by
means
of
a
vehicle,
vessel,
or
pack
30
animal.

(ii)
Facilities
services
including
but
not
limited
to
32
providing
tents,
cabins,
camp
gear,
food,
or
similar
supplies,
33
equipment,
or
accommodations.

Guiding,
leading,
packing,
protecting,
supervising,

instructing,
or
training
individuals
or
groups
in
the
take
or
1
attempted
take
of
wildlife.

After
the
six
thousand
antlered
or
any
sex
nonresident
3
deer
hunting
licenses
have
been
issued,
all
additional
licenses
4
shall
be
issued
for
antlerless
deer
only.
The
commission
shall
5
annually
determine
the
number
of
nonresident
antlerless
deer
6
only
deer
hunting
licenses
that
will
be
available
for
issuance.

EXPLANATION

The
inclusion

this
explanation

constitute
agreement
with

the
members
of
the
general
assembly.

This
bill
relates
to
nonresident
deer
hunting
licenses
11
issued
by
the
natural
resource
commission
(NRC).
Currently,
12
NRC
issues
up
to
6,000
antlered
or
any
sex
deer
hunting
13
licenses
to
nonresidents,
which
are
allocated
among
zones
14
based
on
deer
populations.
Not
more
than
35
percent
of
the
15
licenses
shall
be
bow
season
licenses.
The
bill
requires
NRC
16
to
reserve
500
of
the
nonresident
antlered
or
any
sex
deer
17
hunting
licenses
for
nonresidents
who
have
made
a
reservation
18
with
an
outfitter,
as
defined
in
the
bill,
that
is
currently
19
registered
as
a
business
entity
with
the
secretary
of
state
20
and
has
maintained
registration
since
prior
to
July
1,
2022.

The
bill
prohibits
a
nonresident
from
receiving
more
than
22
one
license
issued
under
Code
section
483A.8(3).
The
bill
23
requires
an
outfitter
to
certify
to
the
department
of
natural
24
resources
that
the
outfitter
is
properly
registered
as
a
25
business
entity.
If
fewer
than
500
nonresidents
apply
for
a
26
reserved
license
by
the
application
deadline
set
by
NRC,
the
27
excess
reserved
licenses
shall
be
available
for
purchase
in
the
28
same
manner
as
other
excess
nonresident
antlered
or
any
sex
29
deer
hunting
licenses.
A
nonresident
shall
include
with
the
30
license
application
evidence
that
the
reservation
is
scheduled
31
for
a
time
during
which
the
license
is
valid.
Not
more
than
35
32
percent
of
the
issued
reserved
licenses
and
not
more
than
35
33
percent
of
the
remaining
licenses
shall
be
bow
season
licenses.

A
person
who
violates
a
provision
of
the
bill
is
subject
to
a
