Section
1.
Section
96.4,
subsection
3,
Code
2019,
is
amended
1
to
read
as
follows:
2
3.
a.
The
individual
is
able
to
work,
is
available
for
3
work,
and
is
earnestly
and
actively
seeking
work.
This
4
subsection
is
waived
if
the
individual
is
deemed
partially
5
unemployed,
while
employed
at
the
individual’s
regular
job,
6
as
defined
in
section
96.19,
subsection
38
,
paragraph
“b”
,
7
subparagraph
(1),
or
temporarily
unemployed
as
defined
in
8
section
96.19,
subsection
38
,
paragraph
“c”
.
The
work
search
9
requirements
of
this
subsection
and
the
disqualification
10
requirement
for
failure
to
apply
for,
or
to
accept
suitable
11
work
of
section
96.5,
subsection
3
,
are
waived
if
the
12
individual
is
not
disqualified
for
benefits
under
section
96.5,
13
subsection
1
,
paragraph
“h”
.

b.
An
employer
may
report
to
the
department
in
a
manner
15
prescribed
by
the
department
a
job
applicant
who
applies
16
for
a
job
for
which
the
applicant
does
not
meet
the
minimum
17
lawful
requirements
or
for
which
the
applicant
is
manifestly
18
unqualified.
If
such
an
individual
claimed
benefits
for
the
19
week
during
which
the
application
was
made,
the
department
20
shall
provide
the
individual
written
notice
that
such
a
report
21
has
been
made.
If
three
such
reports
regarding
an
individual
22
are
made
during
the
individual’s
benefit
year
for
applications
23
during
weeks
in
which
the
individual
claimed
benefits,
the
24
department
shall
initiate
an
investigation
as
to
whether
the
25
individual
was
earnestly
and
actively
seeking
work
during
the
26
weeks
in
question.
There
shall
be
a
rebuttable
presumption
27
that
such
an
individual
was
not
earnestly
and
actively
seeking
28
work
during
the
weeks
in
question.
Such
an
individual
shall
29
be
subject
to
any
applicable
penalties
provided
under
this
30
chapter.

Sec.
2.
APPLICABILITY.
This
Act
applies
to
any
new
claim
of
32
unemployment
benefits
with
an
effective
date
on
or
after
July
33
7,
2019.

inclusion

This
bill
authorizes
an
employer
to
report
to
the
department
3
of
workforce
development
a
job
applicant
who
applies
for
4
a
job
for
which
the
applicant
does
not
meet
the
minimum
5
lawful
requirements
or
for
which
the
applicant
is
manifestly
6
unqualified.
If
such
an
individual
claimed
unemployment
7
benefits
for
the
week
during
which
the
application
was
made,
8
the
bill
requires
the
department
to
provide
the
individual
9

a

has

made.
If

are
not
limited
to
disqualification
from

eligibility
for
unemployment
benefits
pursuant
to
Code
section
23
96.5,
subsection
3.

The
bill
applies
to
any
new
claim
of
unemployment
benefits
25
with
an
effective
date
on
or
after
July
7,
2019.
