S.F. _____ Section 1. NEW SECTION . 73A.29 Contractors for public 1 improvement projects —— list of subcontractors. 2 A contractor, after being awarded a contract for a 3 public improvement project and prior to performing work as a 4 contractor on the public improvement project, shall provide to 5 the labor commissioner a list of each tier of subcontractors 6 who will perform work on the project to ensure compliance with 7 sections 91C.2, 91C.3, 91C.4, and 91C.7 and rules adopted to 8 implement those sections. 9 Sec. 2. APPLICABILITY. This Act applies to contracts for 10 public improvement projects awarded on or after January 1, 11 2021. 12 EXPLANATION 13 The inclusion of this explanation does not constitute agreement with 14 the explanation’s substance by the members of the general assembly. 15 This bill requires that a contractor provide the labor 16 commissioner with a list of each tier of subcontractors who 17 will perform work on a public improvement project after being 18 awarded a contract for a public improvement project and prior 19 to performing work as a contractor on the public improvement 20 project to ensure compliance with statutory provisions 21 relating to registration, registration fees, bonding, workers’ 22 compensation, and unemployment insurance. 23 Current Code defines “public improvement” as any building or 24 construction work which is constructed, repaired, remodeled, 25 or demolished under the control of a governmental entity and 26 is paid for in whole or in part with funds of the governmental 27 entity, including a building or improvement constructed or 28 operated jointly with any other public or private agency. 29 The bill applies to contracts for public improvement 30 projects awarded on or after January 1, 2021. 31 -1- LSB 5744XC (3) 88 je/rn 1/ 1
