2 | AMENDMENT NO. ______. Amend House Bill 1638 on page 1 by | ||||||
3 | replacing line 5 with the following:

4 | "changing Sections 5-2.1d and 5-4.2 as follows:
| ||||||
5 | (305 ILCS 5/5-2.1d) | ||||||
6 | Sec. 5-2.1d. Retroactive eligibility. An applicant for | ||||||
7 | medical assistance may be eligible for up to 3 months prior to | ||||||
8 | the date of application if the person would have been eligible | ||||||
9 | for medical assistance at the time he or she received the | ||||||
10 | services if he or she had applied, regardless of whether the | ||||||
11 | individual is alive when the application for medical assistance | ||||||
12 | is made. In determining financial eligibility for medical | ||||||
13 | assistance for retroactive months, the Department shall | ||||||
14 | consider the amount of income and resources and exemptions | ||||||
15 | available to a person as of the first day of each of the | ||||||
16 | backdated months for which eligibility is sought. The |

1 | Department shall receive the approval of the General Assembly | ||||||
2 | prior to applying for a waiver to reduce or eliminate the | ||||||
3 | State's authority to grant eligibility for up to 3 months prior | ||||||
4 | to the date of application.
