1 | AMENDMENT TO HOUSE BILL 2504

2 | AMENDMENT NO. ______. Amend House Bill 2504 by replacing | ||||||
3 | everything after the enacting clause with the following:

4 | "Section 5. The State Records Act is amended by adding | ||||||
5 | Section 17.5 as follows:
| ||||||
6 | (5 ILCS 160/17.5 new) | ||||||
7 | Sec. 17.5. Destruction of records of law enforcement | ||||||
8 | misconduct. | ||||||
9 | (a) As used in this Section, "law enforcement agency" has | ||||||
10 | the meaning prescribed to that term in subsection (b) of | ||||||
11 | Section 17. | ||||||
12 | (b) After the effective date of this amendatory Act of the | ||||||
13 | 101st General Assembly, a law enforcement agency may not | ||||||
14 | destroy any record relating to complaints, investigations, and | ||||||
15 | adjudications of misconduct by law enforcement officers of the | ||||||
16 | law enforcement agency.
