2 | AMENDMENT NO. ______. Amend Senate Bill 2278 by replacing | ||||||
3 | everything after the enacting clause with the following:
| ||||||
4 | "Section 5. The Illinois Highway Code is amended by | ||||||
5 | changing Section 6-201.22 as follows:
| ||||||
6 | (605 ILCS 5/6-201.22) | ||||||
7 | Sec. 6-201.22. Truck length Road weight restriction; | ||||||
8 | notice and hearing. If not already required by the local | ||||||
9 | ordinance or resolution process, jurisdictions at a minimum | ||||||
10 | must follow the public notification process set forth in this | ||||||
11 | Section. Whenever the local authorities with respect to | ||||||
12 | highways under their jurisdiction wish highway commissioner | ||||||
13 | wishes to permanently post a road to prohibit trucks over 55 | ||||||
14 | feet in length, they at a reduced weight limit, he or she shall | ||||||
15 | fix a time and place to examine the section of roadway route of | ||||||
16 | the township or district road , and hear reasons for or against |

| |||||||
1 | permanently posting a road at a reduced truck length weight | ||||||
2 | limit. | ||||||
3 | The local authority highway commissioner shall give | ||||||
4 | written notice at least 10 days prior to the time of | ||||||
5 | examination or and hearing to the public county superintendent | ||||||
6 | of highways . The local authority He or she shall also provide | ||||||
7 | notice by publication in at least one newspaper published in | ||||||
8 | the jurisdiction township or district . In the absence of a | ||||||
9 | newspaper published in the jurisdiction township or district , | ||||||
10 | notice by publication shall be provided in at least one | ||||||
11 | newspaper of general circulation in the jurisdiction township | ||||||
12 | or district . In the absence of a generally circulated | ||||||
13 | newspaper in the jurisdiction township or district , notice by | ||||||
14 | publication shall be made by posting notices in 5 of the most | ||||||
15 | public places in the jurisdiction district in the vicinity of | ||||||
16 | the road to be permanently posted at a reduced truck length | ||||||
17 | weight limit. | ||||||
18 | The highway commissioner may, by written notice to the | ||||||
19 | county superintendent of highways, by public announcement, and | ||||||
20 | by posting notice at the time and place named for the first | ||||||
21 | hearing, adjourn a hearing from time to time, but not for a | ||||||
22 | longer period than 10 days. At the hearing, or the adjourned | ||||||
23 | hearing, the commissioner shall decide and publicly announce | ||||||
24 | whether he or she will permanently post a road at a reduced | ||||||
25 | weight limit. The highway commissioner shall issue a signed | ||||||
26 | memorandum explaining the decision to permanently post a road |

1 | at a reduced weight limit, and address any concerns raised at | ||||||
2 | the public hearing. The signed memorandum shall be filed | ||||||
3 | within 5 days after the hearing in the office of the district | ||||||
4 | clerk. The highway commissioner shall also send a copy of the | ||||||
5 | signed memorandum to the county superintendent of highways. | ||||||
6 | The county superintendent of highways may approve the decision | ||||||
7 | of the highway commissioner by signing the memorandum and | ||||||
8 | filing it in the office of the district clerk. Upon the | ||||||
9 | approval of the decision by the county superintendent of | ||||||
10 | highways and filing of the memorandum with the office of the | ||||||
11 | district clerk, the road may be posted at a reduced weight | ||||||
12 | limit by the highway commissioner.

15 | changing Sections 15-103, 15-107, 15-116, and 15-316 as | ||||||

18 | Sec. 15-103. Height of vehicles. Except as provided in | ||||||
19 | Section 15-316, the The height of a vehicle from the under side | ||||||
20 | of the tire to the top of
the vehicle, inclusive of load, shall | ||||||
21 | not exceed 13 feet,
6 inches on any highway in the State.

22 | A person convicted of violating this Section is subject to | ||||||
23 | the penalty
provided in paragraph (b) of Section 15-113.

2 | Sec. 15-107. Length of vehicles.
| ||||||
3 | (a) The maximum length of a single vehicle on any highway | ||||||
4 | of this State
may not exceed 42 feet except the following:
| ||||||
5 | (1) Semitrailers.
| ||||||
6 | (2) Charter or regulated route buses may be up to 45 | ||||||
7 | feet in length, not
including energy absorbing bumpers.
| ||||||
8 | (a-1) A motor home as defined in Section 1-145.01 may be up | ||||||
9 | to 45 feet
in length, not including energy absorbing bumpers. | ||||||
10 | The length limitations
described in this subsection (a-1) | ||||||
11 | shall be exclusive of energy-absorbing
bumpers and rear view | ||||||
12 | mirrors.
| ||||||
13 | (b) (Blank).
| ||||||
14 | (c) Except as provided in subsections (c-1) and (c-2), | ||||||
15 | combinations of vehicles may not exceed a total of 2 vehicles | ||||||
16 | except
the
following:
| ||||||
17 | (1) A truck tractor semitrailer may draw one trailer.
| ||||||
18 | (2) A truck tractor semitrailer may draw one converter | ||||||
19 | dolly or one semitrailer.
| ||||||
20 | (3) A truck tractor semitrailer may draw one vehicle | ||||||
21 | that is defined
in Chapter 1 as special mobile equipment, | ||||||
22 | provided the overall dimension does
not
exceed 60 feet.
| ||||||
23 | (4) A truck in transit may draw 3 trucks in transit | ||||||
24 | coupled
together by the triple saddlemount method.
| ||||||
25 | (5) Recreational vehicles consisting of 3 vehicles, |
| |||||||
| |||||||
1 | provided
the following:
| ||||||
2 | (A) The total overall dimension does not exceed 60
| ||||||
3 | feet.
| ||||||
4 | (B) The towing vehicle is a properly registered
| ||||||
5 | vehicle capable of towing another vehicle using a | ||||||
6 | fifth-wheel type assembly.
| ||||||
7 | (C) The second vehicle in the combination of | ||||||
8 | vehicles is
a recreational vehicle that is towed by a
| ||||||
9 | fifth-wheel assembly. This vehicle must be
properly | ||||||
10 | registered and must be equipped with
brakes, | ||||||
11 | regardless of weight.
| ||||||
12 | (D) The third vehicle must be the
lightest of the 3 | ||||||
13 | vehicles and be a trailer or
semitrailer designed or | ||||||
14 | used for
transporting a boat, all-terrain vehicle,
| ||||||
15 | personal watercraft, or motorcycle.
| ||||||
16 | (E) The towed vehicles may be only for the use
of | ||||||
17 | the operator of the towing vehicle.
| ||||||
18 | (F) All vehicles must be properly equipped with
| ||||||
19 | operating brakes and safety equipment required by this | ||||||
20 | Code, except the
additional
brake requirement in | ||||||
21 | subdivision (C) of this subparagraph (5).
| ||||||
22 | (6) A tow truck in combination with a disabled vehicle | ||||||
23 | or combination
of
disabled vehicles, provided the towing | ||||||
24 | vehicle:
| ||||||
25 | (A) Is specifically designed as a tow truck having | ||||||
26 | a gross vehicle
weight rating of
at least 18,000 |
| |||||||
| |||||||
1 | pounds and equipped with air brakes, provided that air | ||||||
2 | brakes
are
required only if the towing vehicle is | ||||||
3 | towing a vehicle, semitrailer, or
tractor-trailer | ||||||
4 | combination that is equipped with air brakes. For the | ||||||
5 | purpose
of this
subsection, gross vehicle weight | ||||||
6 | rating, or GVWR, means the value
specified by the | ||||||
7 | manufacturer as the loaded weight of the tow truck.
| ||||||
8 | (B) Is equipped with flashing, rotating, or | ||||||
9 | oscillating amber lights,
visible for at
least 500 | ||||||
10 | feet in all directions.
| ||||||
11 | (C) Is capable of utilizing the lighting and | ||||||
12 | braking systems of the
disabled
vehicle or combination | ||||||
13 | of vehicles.
| ||||||
14 | (D) Does not engage a tow exceeding 50 highway | ||||||
15 | miles from the initial
point of
wreck or disablement | ||||||
16 | to a place of repair. Any additional movement of the
| ||||||
17 | vehicles may occur only upon issuance of authorization | ||||||
18 | for that movement under
the provisions of Sections | ||||||
19 | 15-301 through 15-318 of this Code.
| ||||||
20 | The Department may by rule or regulation prescribe | ||||||
21 | additional
requirements
regarding length limitations for a | ||||||
22 | tow truck towing another vehicle.
| ||||||
23 | For purposes of this Section, a tow-dolly that merely | ||||||
24 | serves as
substitute
wheels for another legally licensed | ||||||
25 | vehicle is considered part of the
licensed
vehicle and not | ||||||
26 | a separate vehicle.

| |||||||
1 | (7) Commercial vehicles consisting of 3 vehicles, | ||||||
2 | provided the following: | ||||||
3 | (A) The total overall dimension does not exceed 65 | ||||||
4 | feet. | ||||||
5 | (B) The towing vehicle is a properly registered | ||||||
6 | vehicle capable of towing another vehicle using a | ||||||
7 | fifth-wheel type assembly or a goose-neck hitch ball. | ||||||
8 | (C) The third vehicle must be the lightest of the 3 | ||||||
9 | vehicles and be a trailer or semitrailer. | ||||||
10 | (D) All vehicles must be properly equipped with | ||||||
11 | operating brakes and safety equipment required by this | ||||||
12 | Code.
| ||||||
13 | (E) The combination of vehicles must be operated | ||||||
14 | by a person who holds a commercial driver's license | ||||||
15 | (CDL).
| ||||||
16 | (F) The combination of vehicles must be en route | ||||||
17 | to a location where new or used trailers are sold by an | ||||||
18 | Illinois or out-of-state licensed new or used trailer | ||||||
19 | dealer.
| ||||||
20 | (c-1) A combination of 3 vehicles is allowed access to any | ||||||
21 | State designated highway if: | ||||||
22 | (1) the length of neither towed vehicle exceeds 28.5 | ||||||
23 | feet; | ||||||
24 | (2) the overall wheel base of the combination of | ||||||
25 | vehicles does not exceed 62 feet; and
| ||||||
26 | (3) the combination of vehicles is en route to a |
| |||||||
| |||||||
1 | location where new or used trailers are sold by an | ||||||
2 | Illinois or out-of-state licensed new or used trailer | ||||||
3 | dealer.
| ||||||
4 | (c-2) A combination of 3 vehicles is allowed access from | ||||||
5 | any State designated highway onto any county, township, or | ||||||
6 | municipal highway for a distance of 5 highway miles for the | ||||||
7 | purpose of delivery or collection of one or both of the towed | ||||||
8 | vehicles if: | ||||||
9 | (1) the length of neither towed vehicle exceeds 28.5 | ||||||
10 | feet; | ||||||
11 | (2) the combination of vehicles does not exceed 40,000 | ||||||
12 | pounds in gross weight and 8 feet 6 inches in width; | ||||||
13 | (3) there is no sign prohibiting that access; | ||||||
14 | (4) the route is not being used as a thoroughfare | ||||||
15 | between State designated highways; and
| ||||||
16 | (5) the combination of vehicles is en route to a | ||||||
17 | location where new or used trailers are sold by an | ||||||
18 | Illinois or out-of-state licensed new or used trailer | ||||||
19 | dealer.
| ||||||
20 | (d) On Class I highways there are no overall length | ||||||
21 | limitations on motor
vehicles
operating in combinations | ||||||
22 | provided:
| ||||||
23 | (1) The length of a semitrailer, unladen or with load,
| ||||||
24 | in combination with a truck tractor may not exceed 53 | ||||||
25 | feet.
| ||||||
26 | (2) The distance between the kingpin and the center of
|
| |||||||
| |||||||
1 | the rear axle of a semitrailer longer than 48 feet, in | ||||||
2 | combination
with a truck tractor, may not exceed 45 feet 6 | ||||||
3 | inches. The limit contained in this paragraph (2) shall | ||||||
4 | not apply to trailers or semi-trailers used for the | ||||||
5 | transport of livestock as defined by Section 18b-101.
| ||||||
6 | (3) The length of a semitrailer or trailer, unladen or
| ||||||
7 | with load, operated in a truck tractor-semitrailer-trailer
| ||||||
8 | or truck tractor semitrailer-semitrailer combination, may | ||||||
9 | not exceed 28 feet 6 inches.
| ||||||
10 | (4) Maxi-cube combinations, as defined in Chapter 1,
| ||||||
11 | may not exceed 65 feet overall dimension.
| ||||||
12 | (5) Combinations of vehicles specifically designed to
| ||||||
13 | transport motor vehicles or boats may not exceed 65 feet
| ||||||
14 | overall dimension. The length limitation is inclusive of
| ||||||
15 | front and rear bumpers but exclusive of the overhang of | ||||||
16 | the
transported vehicles, as provided in paragraph (i) of | ||||||
17 | this
Section.
| ||||||
18 | (6) Stinger-steered semitrailer vehicles specifically | ||||||
19 | designed to transport motor vehicles or
boats and | ||||||
20 | automobile transporters, as defined in Chapter 1, may not | ||||||
21 | exceed 80 feet overall dimension. The length
limitation is | ||||||
22 | inclusive of front and rear bumpers but
exclusive of the | ||||||
23 | overhang of the transported vehicles, as
provided in | ||||||
24 | paragraph (i) of this Section.
| ||||||
25 | (7) A truck in transit transporting 3 trucks coupled
| ||||||
26 | together by the triple saddlemount method may not
exceed |
| |||||||
| |||||||
1 | 97 feet overall dimension.
| ||||||
2 | (8) A towaway trailer transporter combination may not | ||||||
3 | exceed 82 feet overall dimension. | ||||||
4 | Vehicles operating during daylight hours when transporting | ||||||
5 | poles, pipes,
machinery, or other objects of a structural | ||||||
6 | nature that cannot readily be dismantled or disassembled
are | ||||||
7 | exempt from length limitations, provided that no object may
| ||||||
8 | exceed 80 feet in length and the overall dimension of the | ||||||
9 | vehicle including the
load
may not exceed 100 feet. This | ||||||
10 | exemption does not apply to operation on a
Saturday, Sunday, | ||||||
11 | or legal holiday. Legal holidays referred to in this Section
| ||||||
12 | are
the days on which the following traditional holidays are | ||||||
13 | celebrated: New
Year's
Day; Memorial Day; Independence Day; | ||||||
14 | Labor Day; Thanksgiving Day; and
Christmas Day.
| ||||||
15 | Vehicles and loads operated by a public utility while en | ||||||
16 | route to make
emergency repairs to public service facilities | ||||||
17 | or properties are exempt from
length
limitations, provided | ||||||
18 | that during night operations every vehicle and its load
must
| ||||||
19 | be equipped with a sufficient number of clearance lamps on | ||||||
20 | both sides and
marker lamps on the extreme ends of any | ||||||
21 | projecting load to clearly mark the
dimensions of the load.
| ||||||
22 | A tow truck in combination with a disabled vehicle or | ||||||
23 | combination of
disabled vehicles, as provided in paragraph (6) | ||||||
24 | of subsection (c) of this
Section, is
exempt from length | ||||||
25 | limitations.
| ||||||
26 | The length limitations described in this paragraph (d) |
| |||||||
| |||||||
1 | shall be exclusive
of safety and energy conservation devices,
| ||||||
2 | such as bumpers, refrigeration
units or air compressors and | ||||||
3 | other devices, that the Department may interpret
as necessary | ||||||
4 | for safe and efficient
operation; except that no device | ||||||
5 | excluded under this paragraph shall have by
its design or use | ||||||
6 | the capability to carry cargo.
| ||||||
7 | Section 5-35 of the Illinois Administrative Procedure Act | ||||||
8 | relating to
procedures for rulemaking shall not apply to the | ||||||
9 | designation of highways under
this paragraph (d).
| ||||||
10 | (e) On Class II highways there are no overall length | ||||||

11 | (1) From a Class I highway onto any street or highway | ||||||
12 | for a distance of
one highway mile for the purpose of | ||||||
13 | loading, unloading, food, fuel, repairs,
and rest, | ||||||
14 | provided there is no sign prohibiting that access. | ||||||
15 | (2) From a Class I or Class II highway onto any | ||||||
16 | non-designated highway for a distance of 5 highway miles | ||||||
17 | for the purpose
of loading, unloading, food, fuel, | ||||||
18 | repairs, and rest if: | ||||||
19 | (A) there is no sign prohibiting that access; and | ||||||
20 | (B) the route is not being used as a thoroughfare | ||||||
21 | between Class I or Class II highways. | ||||||
22 | (e-3) Combinations of vehicles over 65 feet in length | ||||||
23 | operated by household
goods carriers or towaway trailer | ||||||
24 | transporter combinations, with no overall length limitations | ||||||
25 | except as provided in
subsections (d) and (e) of this Section, | ||||||
26 | have unlimited access to points of
loading,
unloading, or |
| |||||||
| |||||||
1 | delivery to or from a manufacturer, distributor, or dealer. | ||||||
2 | (f) On non-designated highways, except as provided in | ||||||
3 | Section 15-316, the maximum length
limitations
for vehicles in | ||||||
4 | combination are as follows:
| ||||||
5 | (1) A truck tractor in combination with a semitrailer | ||||||
6 | may not exceed 65 feet overall dimension. An agency or | ||||||
7 | instrumentality of the State of Illinois or any unit of | ||||||
8 | local government shall not be required to widen or | ||||||
9 | otherwise alter a non-designated highway constructed | ||||||
10 | before January 1, 2018 to accommodate truck | ||||||
11 | tractor-semitrailer combinations under this paragraph (1).
| ||||||
12 | (2) Semitrailers, unladen or with load, may not exceed
| ||||||
13 | 53 feet overall dimension.
| ||||||
14 | (3) A truck tractor-semitrailer-trailer or truck | ||||||
15 | tractor semitrailer-semitrailer may not exceed 60 feet | ||||||
16 | overall dimension.
| ||||||
17 | (4) The distance between the kingpin and the center | ||||||
18 | axle of a
semitrailer longer than 48 feet, in combination | ||||||
19 | with a truck tractor, may
not exceed 42 feet 6 inches. The | ||||||
20 | limit contained in this paragraph (4) shall not apply to | ||||||
21 | trailers or semi-trailers used for the transport of | ||||||
22 | livestock as defined by Section 18b-101.

6 | authorized in Section 15-301. As used in this Section, | ||||||
7 | "legal holiday" means any of the following days: New | ||||||

9 | Thanksgiving Day; and Christmas Day.

10 | (2) Vehicles and loads operated by a public utility | ||||||
11 | while en route to make
emergency repairs to public service | ||||||
12 | facilities or properties, but during
night operation every | ||||||
13 | vehicle and its load must be equipped with
a
sufficient | ||||||
14 | number of clearance lamps on both sides and marker lamps | ||||||
15 | upon the
extreme ends of any projecting load to clearly | ||||||
16 | mark the dimensions of the load.

17 | (3) A tow truck in combination with a disabled vehicle | ||||||
18 | or combination of disabled vehicles, as provided in | ||||||
19 | paragraph (6) of subsection (c) of this Section, is exempt | ||||||
20 | from length limitations.

The towing vehicle, however, may tow any disabled vehicle | ||||||
22 | from the initial
point of wreck or disablement to a point where | ||||||
23 | repairs are actually to occur.
This movement shall be valid | ||||||
24 | only on State routes.
The tower must abide by posted bridge | ||||||
25 | weight limits.

2 | (h) The load upon any vehicle operated alone, or the load | ||||||

5 | or the front bumper of the
vehicle if it is equipped with a | ||||||
6 | front bumper.
The provisions of this subsection (h) shall not | ||||||
7 | apply to any vehicle or
combination of vehicles specifically | ||||||
8 | designed for the collection and
transportation of waste, | ||||||
9 | garbage, or recyclable materials during the vehicle's
| ||||||
10 | operation in the course of collecting
garbage, waste, or
| ||||||
11 | recyclable materials if the vehicle is traveling at a speed | ||||||
12 | not in
excess of
15 miles per hour during the vehicle's | ||||||
13 | operation and in the course of
collecting garbage, waste, or | ||||||
14 | recyclable materials. However, in no instance
shall the load | ||||||
15 | extend more than 7 feet beyond the front wheels of the vehicle
| ||||||
16 | or the front bumper of the vehicle if it is equipped with a | ||||||
17 | front bumper.
| ||||||
18 | (i) The load upon the front vehicle of an automobile | ||||||
19 | transporter or a stinger-steered vehicle
specifically designed | ||||||
20 | to transport motor vehicles shall not extend more
than 4 feet | ||||||
21 | beyond the foremost part of the transporting vehicle and the
| ||||||
22 | load upon the rear transporting vehicle shall not extend more | ||||||
23 | than 6 feet
beyond the rear of the bed or body of the vehicle. | ||||||
24 | This paragraph shall
only be applicable upon highways | ||||||
25 | designated in paragraphs (d) and (e) of
this Section.

26 | (j) Articulated vehicles comprised of 2 sections, neither |
| |||||||
| |||||||
1 | of which
exceeds a length of 42 feet, designed for the carrying | ||||||
2 | of more than 10
persons, may be up to 60 feet in length, not | ||||||
3 | including energy absorbing
bumpers, provided that the vehicles | ||||||
4 | are:
| ||||||
5 | 1. operated by or for any public body or motor carrier | ||||||
6 | authorized by law
to provide public transportation | ||||||
7 | services; or
| ||||||
8 | 2. operated in local public transportation service by | ||||||
9 | any other person
and the municipality in which the service | ||||||
10 | is to be provided approved the
operation of the vehicle.

12 | (k) Any person who is convicted of violating this Section | ||||||
13 | is subject
to the penalty as provided in paragraph (b) of | ||||||

18 | Sec. 15-116. Highway designations. | ||||||
19 | (a) The Department of Transportation shall maintain and | ||||||
20 | provide a listing of all Class I and Class II designated | ||||||
21 | streets and highways as defined in Chapter 1 of this Code.
| ||||||
22 | (b) The Department shall also maintain and provide a | ||||||
23 | listing of all local streets or highways that have been | ||||||
24 | designated Class II by local agencies. | ||||||
25 | (c) Local agencies shall be responsible for reporting to |
| |||||||
| |||||||
1 | the Department all streets and highways under their | ||||||
2 | jurisdiction designated Class II. Local agencies shall also | ||||||
3 | provide to the Department reference contact names and | ||||||
4 | telephone numbers.
| ||||||
5 | (d) The Department shall also maintain and provide an | ||||||
6 | official map of the Designated State Truck Route System that | ||||||
7 | includes State and local streets and highways that have been | ||||||
8 | designated Class I or Class II.
| ||||||
9 | (e) If a unit of local government has no Class II | ||||||
10 | designated truck routes, the unit of local government shall | ||||||
11 | affirm to the Department that it has no such truck routes. | ||||||
12 | (f) Each unit of local government shall may report to the | ||||||
13 | Department, and the Department shall post on its official | ||||||
14 | website, any limitations prohibiting the operation of vehicles | ||||||
15 | imposed by ordinance or resolution in the unit of local | ||||||
16 | government's non-designated highway system. | ||||||

19 | Sec. 15-316. When the Department or local authority may | ||||||
20 | restrict right to use highways.
| ||||||
21 | (a) Except as provided in subsection (g), local | ||||||
22 | authorities with
respect to highways under their jurisdiction | ||||||
23 | may by ordinance or resolution
prohibit the operation of | ||||||
24 | vehicles upon any such highway or impose
restrictions as to | ||||||
25 | the weight of vehicles to be operated upon any such
highway, |

1 | for a total period of not to exceed 90 days, measured in either | ||||||
2 | consecutive or nonconsecutive days at the discretion of local | ||||||
3 | authorities, in any one calendar
year, whenever any said | ||||||
4 | highway by reason of deterioration, rain, snow, or
other | ||||||
5 | climate conditions will be seriously damaged or destroyed | ||||||
6 | unless the
use of vehicles thereon is prohibited or the | ||||||
7 | permissible weights thereof
reduced.

8 | (b) The local authority
enacting any such ordinance or | ||||||
9 | resolution shall erect or cause to be erected
and maintained | ||||||
10 | signs designating the provision of the ordinance or resolution
| ||||||
11 | at each end of that portion of any highway affected thereby, | ||||||
12 | and the ordinance
or resolution shall not be effective unless | ||||||
13 | and until such signs are erected
and maintained. To be | ||||||
14 | effective, an ordinance or resolution passed to designate a | ||||||
15 | Class II roadway need not require that signs be erected, but | ||||||
16 | the designation shall be reported to the Department.
| ||||||
17 | (c) Local authorities with
respect to highways under their | ||||||
18 | jurisdiction may also, by ordinance or
resolution, prohibit | ||||||
19 | the operation of trucks or other commercial vehicles,
or may | ||||||
20 | impose limitations as the weight or length thereof, on | ||||||
21 | designated highways, which
prohibitions and limitations shall | ||||||
22 | be marked designated by appropriate signs placed on
such | ||||||
23 | highways.

24 | (c-1) (Blank).
| ||||||
25 | (c-5) Highway commissioners, with respect to roads under | ||||||
26 | their authority, may not permanently post a road or portion |
| |||||||
| |||||||
1 | thereof at a reduced weight limit unless the decision to do so | ||||||
2 | is made in accordance with Section 6-201.22 of the Illinois | ||||||
3 | Highway Code. | ||||||
4 | (d) The Department shall likewise have authority as | ||||||
5 | hereinbefore
granted to local authorities to
determine by | ||||||
6 | resolution and to impose restrictions as to the weight or | ||||||
7 | length of vehicles
operated upon any highway under the | ||||||
8 | jurisdiction of said department, and such
restrictions shall | ||||||
9 | be effective when signs giving notice thereof are erected
upon | ||||||
10 | the highway or portion of any highway affected by such | ||||||
11 | resolution.

14 | (e) When any vehicle is operated in violation of this | ||||||
15 | Section, the owner
or driver of the vehicle shall be deemed | ||||||
16 | guilty of a violation and either the
owner or the driver of the | ||||||
17 | vehicle may be prosecuted for the violation. Any
person, firm, | ||||||
18 | or corporation convicted of violating this Section shall be | ||||||
19 | fined
$50 for any weight exceeding the posted limit up to the | ||||||
20 | axle or gross weight
limit allowed a vehicle as provided for in | ||||||
21 | subsections (a) or (b) of Section
15-111 and $75 per every 500 | ||||||
22 | pounds or fraction thereof for any weight
exceeding that which | ||||||
23 | is provided for in subsections (a) or
(b) of Section 15-111.

24 | (f) A municipality is authorized to enforce a county | ||||||
25 | weight limit
ordinance applying to county highways within its | ||||||
26 | corporate limits and is
entitled to the proceeds of any fines |
| |||||||
| |||||||
1 | collected from the enforcement.
| ||||||
2 | (g) An ordinance or resolution enacted by a county or | ||||||
3 | township pursuant to subsection (a) of this Section shall not | ||||||
4 | apply to cargo tank vehicles with two or three permanent axles | ||||||
5 | when delivering propane for emergency heating purposes if the | ||||||
6 | cargo tank is loaded at no more than 50 percent capacity, the | ||||||
7 | gross vehicle weight of the vehicle does not exceed 32,000 | ||||||
8 | pounds, and the driver of the cargo tank vehicle notifies the | ||||||
9 | appropriate agency or agencies with jurisdiction over the | ||||||
10 | highway before driving the vehicle on the highway pursuant to | ||||||
11 | this subsection. The cargo tank vehicle must have an operating | ||||||
12 | gauge on the cargo tank which indicates the amount of propane | ||||||
13 | as a percent of capacity of the cargo tank. The cargo tank must | ||||||
14 | have the capacity displayed on the cargo tank, or | ||||||
15 | documentation of the capacity of the cargo tank must be | ||||||
16 | available in the vehicle. For the purposes of this subsection, | ||||||
17 | propane weighs 4.2 pounds per gallon. This subsection does not | ||||||
18 | apply to municipalities. Nothing in this subsection shall | ||||||
19 | allow cargo tank
vehicles
to cross bridges with posted weight | ||||||
20 | restrictions if the vehicle exceeds the posted weight limit. | ||||||
