Summary
Reinserts the provisions of the engrossed bill with changes. Further amends the Liquor Control Act of 1934. Provides that inspectors obtained by the Liquor Control Commission shall not be peace officers and shall not exercise any powers of a peace officer. Provides that investigators of the State Commission are peace officers with jurisdiction, including arrest powers, throughout the State. Provides that no investigator shall exercise the powers of a peace officer until he or she has qualified as a peace officer according to the requirements set by the Illinois Law Enforcement Training Standards Board. Requires the Executive Director of the State Commission to authorize each investigator and to issue a distinctive badge and identification. Provides that if any person is shipping alcoholic liquor into the State from a point outside the State in violation of the Act, authorizes the State Commission to issue a cease and desist notice, impose civil penalties, notify the foreign jurisdiction, or file a complaint with the State's Attorney's Office or the Attorney General. Provides that any retailer, caterer retailer, brew pub, special event retailer, special use permit holder, homebrewer special event permit holder, or craft distiller tasting permit holder who knowingly causes alcoholic liquors to be imported directly into the State from outside of the State for the purpose of furnishing, giving, or selling to another, except when having received the product from a duly licensed distributor or importing distributor, shall have his license suspended for 30 days (instead of 7 days) for the first offense. Provides that, upon receipt of a complaint or upon having knowledge that a person is engaged in the business as a manufacturer, importing distributor, distributor, or retailer, the State Commission shall conduct an investigation. Provides that the State Commission may investigate any and all unlicensed activity, may issue cease and desist notices, and may impose civil penalties. Makes other changes. Effective immediately.
