1 AN ACT concerning State government.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Department of Public Health Powers and
5Duties Law of the Civil Administrative Code of Illinois is
6amended by adding Section 2310-685 as follows:
7 (20 ILCS 2310/2310-685 new)
8 Sec. 2310-685. Cytomegalovirus public education program.
9 (a) In this Section:
10 "CMV" means cytomegalovirus.
11 "Health care provider" means any physician, hospital
12 facility, or other person that is licensed or otherwise
13 authorized to deliver health care services.
14 (b) The Department shall develop or approve and publish
15informational materials for women who may become pregnant,
16expectant parents, and parents of infants regarding:
17 (1) the incidence of CMV;
18 (2) the transmission of CMV to pregnant women and women
19 who may become pregnant;
20 (3) birth defects caused by congenital CMV;
21 (4) methods of diagnosing congenital CMV;
22 (5) available preventive measures to avoid the
23 infection of women who are pregnant or may become pregnant;

2 (6) treatment options available for children born with
3 congenital CMV.
4 (c) The Department shall publish the information required
5to be published under subsection (b) on its Internet website.
6The Department may not charge a fee for physical copies of the
7materials. The Department shall provide appropriate quantities
8of the materials to any person upon request.
9 (d) The Department shall establish an outreach program to:
10 (1) educate women who may become pregnant, expectant
11 parents, and parents of infants about CMV; and
12 (2) raise awareness of CMV among health care providers
13 who provide care to expectant mothers or infants.
14 (e) The Department may solicit and accept the assistance of
15any relevant medical associations or community resources,
16including faith-based resources, to promote education about
17CMV under this Section.
18 (f) If a newborn infant fails the 2 initial hearing
19screenings in the hospital, then the hospital performing that
20screening shall provide to the parents of the newborn infant
21information regarding: (i) birth defects caused by congenital
22CMV; (ii) testing opportunities and options for CMV, including
23the opportunity to test for CMV before leaving the hospital;
24and (iii) available early intervention services. The
25Department shall develop or approve materials for parents
26described in this subsection (d) and post the materials on its

1website. Health care providers may use the materials developed
2by the Department.
3 (g) The Department shall adopt rules necessary to implement
4this Section.
