Bill Title: Amends the State Commemorative Dates Act to designate the second Thursday in April of each year as D.A.R.E. Day. Amends provisions of the Illinois Vehicle Code concerning D.A.R.E. special registration plates. Provides that all money in the State D.A.R.E. Fund shall be paid, subject to appropriation by the General Assembly and approval by the Secretary of State, as grants to the Illinois D.A.R.E. Officers Association for its D.A.R.E. program (rather than being distributed to the Illinois State Police for its D.A.R.E. program). Provides that distributions from the County D.A.R.E. Fund to counties for their D.A.R.E. programs and from the Municipal D.A.R.E. Fund to municipalities for their D.A.R.E. programs shall be made by the Secretary of State (rather than being made by the Illinois State Police). Effective immediately.

2 | Be it enacted by the People of the State of Illinois,
| ||||||||||||||||||||||||||
3 | represented in the General Assembly:

4 | Section 5. The State Commemorative Dates Act is amended by | ||||||||||||||||||||||||||
5 | adding Section 37 as follows:

6 | (5 ILCS 490/37 new) | ||||||||||||||||||||||||||
7 | Sec. 37. D.A.R.E. Day. The second Thursday in April of each | ||||||||||||||||||||||||||
8 | year is designated as D.A.R.E. Day.

9 | Section 10. The Illinois Vehicle Code is amended by | ||||||||||||||||||||||||||
10 | changing Section 3-637 as follows:

12 | Sec. 3-637. D.A.R.E.
license plate. | ||||||||||||||||||||||||||
13 | (a) The Secretary, upon receipt of an application made in | ||||||||||||||||||||||||||
14 | the form
prescribed by the Secretary of State, may issue | ||||||||||||||||||||||||||
15 | special registration plates
designated to be D.A.R.E. (Drug | ||||||||||||||||||||||||||
16 | Abuse Resistance Education) license plates.
The special plates | ||||||||||||||||||||||||||
17 | issued under this Section shall be affixed only to passenger
| ||||||||||||||||||||||||||
18 | vehicles of the first division, motor vehicles of the second | ||||||||||||||||||||||||||
19 | division weighing
not more than 8,000 pounds, and recreational | ||||||||||||||||||||||||||
20 | vehicles as defined by Section
1-169 of this Code.
Plates | ||||||||||||||||||||||||||
21 | issued under this Section shall expire according to the |

| |||||||
1 | multi-year
procedure established by Section 3-414.1 of this | ||||||
2 | Code.
| ||||||
3 | (b) The design and color of the plates shall be wholly | ||||||
4 | within the discretion
of the Secretary of State. Appropriate | ||||||
5 | documentation, as determined by the
Secretary, shall accompany | ||||||
6 | the application.
The Secretary may, in his or her discretion, | ||||||
7 | allow the
plates to be issued as
vanity or personalized plates | ||||||
8 | in accordance with Section 3-405.1 of this
Code.

9 | (c) An applicant shall be charged a $45 fee for original | ||||||
10 | issuance in
addition to the appropriate registration fee, if | ||||||
11 | applicable. Of this fee, $10
shall be deposited into the State | ||||||
12 | D.A.R.E. Fund; $10 shall
be deposited into the County D.A.R.E. | ||||||
13 | Fund if the county, as indicated by the
applicant's address,
| ||||||
14 | has a D.A.R.E. program, otherwise the $10 fee shall be | ||||||
15 | deposited into
the State D.A.R.E. Fund;
$10 shall be deposited
| ||||||
16 | into the Municipal D.A.R.E. Fund if the municipality, as | ||||||
17 | indicated by the
applicant's address, has a D.A.R.E. program, | ||||||
18 | otherwise the $10 fee shall be
deposited into the County | ||||||
19 | D.A.R.E. Fund if the county, as indicated by the
applicant's | ||||||
20 | address, has a D.A.R.E. program, otherwise the $10 fee shall be
| ||||||
21 | deposited into the State D.A.R.E. Fund;
and $15 shall be | ||||||
22 | deposited into the Secretary of State
Special License Plate | ||||||
23 | Fund.
| ||||||
24 | For each registration renewal period, a $29 fee, in | ||||||
25 | addition to the
appropriate registration fee, shall be charged. | ||||||
26 | Of this fee, $9 shall be
deposited into the State D.A.R.E. |

County D.A.R.E. Fund if | ||||||

county, as indicated by the applicant's address,
has a | ||||||

into the | ||||||
5 | Municipal D.A.R.E. Fund if the municipality, as indicated by | ||||||
6 | the
applicant's address, has a D.A.R.E. program, otherwise the | ||||||
7 | $9 fee shall be
deposited into the County D.A.R.E. Fund if the | ||||||
8 | county, as indicated by the
applicant's address, has a D.A.R.E. | ||||||
9 | program, otherwise the $9 fee shall be
deposited into the State | ||||||
10 | D.A.R.E. Fund;
and $2 shall be deposited into
the Secretary of | ||||||
11 | State Special License Plate Fund.

12 | (d) The State D.A.R.E. Fund is created as a special fund in | ||||||
13 | the State
Treasury. All money in the State D.A.R.E. Fund shall | ||||||
14 | be paid, subject to appropriation by the General Assembly and | ||||||
15 | approval by the Secretary, as grants distributed, subject
to | ||||||
16 | appropriation by the General Assembly, to the Illinois D.A.R.E. | ||||||
17 | Officers Association State Police for its
D.A.R.E. program.
| ||||||
18 | The County D.A.R.E. Fund is created as a special fund in | ||||||
19 | the State Treasury.
All money in the County D.A.R.E. Fund shall | ||||||
20 | be distributed, subject to
appropriation by the General | ||||||
21 | Assembly, to the Secretary Illinois State Police . The
Secretary | ||||||
22 | Illinois State Police shall make grants of this money to | ||||||
23 | counties for their
D.A.R.E. programs based on the proportion of | ||||||
24 | money the County D.A.R.E. Fund has
received from each county, | ||||||
25 | as indicated by the applicant's address.

26 | The Municipal D.A.R.E. Fund is created as a special fund in |

| |||||||
1 | the State
Treasury. All money in the Municipal D.A.R.E. Fund | ||||||
2 | shall be distributed,
subject to appropriation by the General | ||||||
3 | Assembly, to the Secretary Illinois State Police .
The Secretary | ||||||
4 | Illinois State Police shall make grants of this money to | ||||||
5 | municipalities
for their D.A.R.E. programs based on the | ||||||
6 | proportion of money the Municipal
D.A.R.E. Fund has received | ||||||
7 | from each municipality, as indicated by the
applicant's | ||||||
8 | address.
