1 | AN ACT concerning education.
| |||||||||||||||||||
2 | Be it enacted by the People of the State of Illinois, | |||||||||||||||||||
3 | represented in the General Assembly:
| |||||||||||||||||||
4 | Section 5. The Illinois Educational Labor Relations Act is | |||||||||||||||||||
5 | amended by changing Section 3 as follows:
| |||||||||||||||||||

7 | Sec. 3. Employee rights. (a) It shall be lawful for | |||||||||||||||||||
8 | educational employees
to organize, form, join, or assist in | |||||||||||||||||||
9 | employee organizations or engage in
lawful concerted | |||||||||||||||||||
10 | activities for the
the purpose of collective bargaining or
| |||||||||||||||||||
11 | other mutual aid and protection or bargain collectively through | |||||||||||||||||||
12 | representatives
of their own free choice and, except as | |||||||||||||||||||
13 | provided in Section 11, such employees
shall also have the | |||||||||||||||||||
14 | right to refrain from any or all such activities. | |||||||||||||||||||
15 | (b) Representatives selected by educational employees in a | |||||||||||||||||||
16 | unit appropriate
for collective bargaining purposes shall be | |||||||||||||||||||
17 | the exclusive representative
of all the employees in such unit | |||||||||||||||||||
18 | to
bargain on wages, hours, terms and conditions of employment. | |||||||||||||||||||
19 | However,
any individual employee or a group of employees may at | |||||||||||||||||||
20 | any time present
grievances to their employer and have them | |||||||||||||||||||
21 | adjusted without the intervention
of the bargaining | |||||||||||||||||||
22 | representative as long as the adjustment is not inconsistent
| |||||||||||||||||||
23 | with the terms of a collective bargaining agreement then in |
| |||||||
| |||||||

that the bargaining representative has been | ||||||
2 | given an opportunity to be present
at such adjustment.
