1 | AN ACT concerning regulation.

2 | Be it enacted by the People of the State of Illinois, | |||||||||||||||||||
3 | represented in the General Assembly:

4 | Section 5. The Children's Health Insurance Program Act is | |||||||||||||||||||
5 | amended by changing Section 15 as follows:

7 | Sec. 15. Operation of the Program. There is hereby created | |||||||||||||||||||
8 | a
Children's Health Insurance Program. The
The Program shall | |||||||||||||||||||
9 | operate subject
to appropriation and shall be administered by | |||||||||||||||||||
10 | the Department of Healthcare and Family Services. The | |||||||||||||||||||
11 | Department shall have the powers and authority granted to the
| |||||||||||||||||||
12 | Department under the Illinois Public Aid Code, including, but | |||||||||||||||||||
13 | not limited to, Section 11-5.1 of the Code. The Department may | |||||||||||||||||||
14 | contract
with a Third Party Administrator or other entities to | |||||||||||||||||||
15 | administer and oversee
any portion of this Program. Beginning | |||||||||||||||||||
16 | October 1, 2013, the determination of eligibility under this | |||||||||||||||||||
17 | Act shall comply with the requirements of 42 U.S.C. | |||||||||||||||||||
18 | 1397bb(b)(1)(B)(v) and applicable federal regulations. If | |||||||||||||||||||
19 | changes made to this Section require federal approval, they | |||||||||||||||||||
20 | shall not take effect until such approval has been received. | |||||||||||||||||||
