Bill Title: Creates the Purchase of Care and Grant Adjustment Act of 2009. Applies to purchase of care contracts, grant agreements, and provider agreements that (i) provide service for the disabled or (ii) are between specified State agencies and private community-based providers. Requires annual adjustments in accordance with the non-seasonally-adjusted Employment Cost Index. Repealed on July 1, 2010. Effective immediately.

1 | AN ACT concerning finance.
| ||||||||||||||||||||||||
2 | Be it enacted by the People of the State of Illinois,
| ||||||||||||||||||||||||
3 | represented in the General Assembly:

4 | Section 1. Short title. This Act may be cited as the | ||||||||||||||||||||||||
5 | Purchase of Care and Grant Adjustment Act of 2009.
| ||||||||||||||||||||||||
6 | Section 5. Definitions. As used in this Act: | ||||||||||||||||||||||||
7 | "Purchase of care contract" means a contract between a | ||||||||||||||||||||||||
8 | State officer or agency and a private provider under which | ||||||||||||||||||||||||
9 | rates for services are set in accordance with a formula that | ||||||||||||||||||||||||
10 | takes personnel, supplies, and other allowable costs into | ||||||||||||||||||||||||
11 | account. | ||||||||||||||||||||||||
12 | "Grant" has the meaning ascribed to that term in the | ||||||||||||||||||||||||
13 | Illinois Procurement Code.

14 | Section 10. Applicability. This Act applies to all | ||||||||||||||||||||||||
15 | purchase of care contracts, grant agreements, and provider | ||||||||||||||||||||||||
16 | agreements that (i) provide in whole or in part for the | ||||||||||||||||||||||||
17 | provision of services for persons with disabilities or (ii) are | ||||||||||||||||||||||||
18 | entered into between the Department of Children and Family | ||||||||||||||||||||||||
19 | Services, the Department of Human Services, the Department of | ||||||||||||||||||||||||
20 | Corrections, the Department of Public Health, the Department of | ||||||||||||||||||||||||
21 | Commerce and Economic Opportunity, the Department on Aging, the | ||||||||||||||||||||||||
22 | Department of Juvenile Justice, the Office of the Attorney |

1 | General, or the Department of Healthcare and Family Services | ||||||
2 | and a private community-based contractual provider or grantee.

3 | Section 15. Adjustments. Notwithstanding any other | ||||||
4 | provision of law, for fiscal year 2010, purchase of care | ||||||
5 | contracts and grant agreements to which this Act applies must | ||||||
6 | provide for annual adjustments in accordance with the | ||||||
7 | non-seasonally-adjusted Employment Cost Index for total | ||||||
8 | compensation for civilian workers compiled by the U.S. Bureau | ||||||
9 | of Labor Statistics.

10 | Section 90. Repealer. This Act is repealed on July 1, 2010.

11 | Section 99. Effective date. This Act takes effect upon | ||||||
12 | becoming law.
